Further Modification. This Performance Covenant and Waiver may only be modified, amended, changed or terminated by an agreement in writing signed by ▇▇▇▇▇▇ Capital and the undersigned. No waiver of any term, covenant or provision of this Guaranty shall be effective unless given in writing by ▇▇▇▇▇▇ Capital and if so given by ▇▇▇▇▇▇ Capital shall only be effective in the specific instance in which given.
