Common use of Gas Service Clause in Contracts

Gas Service. All extensions of existing gas distribution pipelines, facilities, and appurtenances within individual subdivisions within the FDP Properties necessary to provide natural gas service to the residential and commercial structures to be constructed thereon, to the extent natural gas service to the FDP Properties is commercially available, shall be the responsibility of the party seeking Town development or building approvals for such structures. Such construction shall be required prior to the issuance of any certificate of occupancy for any structure served by the applicable gas distribution pipelines, facilities, and appurtenances. Easements and rights-of-way for the installation, operation, maintenance, repair, and replacement of such natural gas distribution pipelines, facilities, and appurtenances as are reasonably necessary in order for the natural gas utility provider to provide natural gas service to the residential and commercial structures to be constructed, shall be dedicated to the natural gas utility provider by the party constructing such improvements, at such party’s sole cost and expense. Such conveyances shall be made at the time of final subdivision platting for the portion of the FDP Properties which have been designed to contain the applicable gas distribution pipelines, facilities, and appurtenances.
