Common use of Grievance Termination Clause in Contracts

Grievance Termination. Any grievance not appealed to the next step of the Grievance Procedure as specified herein, shall be considered closed. If the Board fails to answer the grievance in the stated time period, except as provided in Level Four of this Article, the grievance shall be considered meritorious and the relief granted. If the Association or a teacher fails to appeal any reply to a grievance within the stated time period, the grievance shall be considered closed in accordance with the Board’s answer. The Association or a teacher reserves the right to take any grievance to the next step of the Grievance Procedure and its action or actions in doing so shall thus be considered final and binding on all parties to the grievance.
