Guarantee of Timely Completion. Contractor specifically acknowledges that time is of the essence in the performance of all of Contractor’s obligations under this Agreement, and the Contractor acknowledges that the Owner will incur substantial monetary and other damages, including consequential damages, if any, in the event Contractor does not achieve Mechanical Completion by the Guaranteed Mechanical Completion Date, as may be extended by Change Order, provided that Contractor’s maximum liability for such delay shall not exceed Five Hundred Thousand Dollars ($500,000) provided further that, such cap shall not (i) be construed to limit Contractor’s obligation to complete the Work for the Estimated Contract Price, as may be amended by Change Order, and (ii) apply in the event of Contractor’s willful misconduct or abandonment of the Work.

Guarantee of Timely Completion. Contractor shall administer and perform the Work generally in accordance with the Project Schedule and guarantees that Commercial Operation shall occur by the Guaranteed Completion Date. Subject to successful Performance Tests that demonstrate achievement of desired plant Performance, a Completion Bonus shall be paid by the GEC to the Contractor for achieving Commercial Operation before the Guaranteed Completion Date, in accordance with Exhibit C-3.

Guarantee of Timely Completion. Contractor shall administer and perform the Work in accordance with the Project Schedule and guarantees that (i) Mechanical Completion shall occur on or before May 15, 2004 (the "Guaranteed Completion Date"), (ii) Substantial Completion shall occur by June 15, 2004 and (iii) Final Completion shall occur by the "End Date," which shall be the date thirty (30) days after the Substantial Completion Date. Time is of the essence in this Agreement with respect to the Guaranteed Completion Date, Substantial Completion and Final Completion. If progress on the Work is significantly delayed other than as a result of Changes (subject to Section 6.5), Force Majeure or Owner Delays, Contractor shall take reasonable actions, including without limitation working overtime, weekends, or holidays, or adding additional personnel, equipment, or work spreads, at no cost to Owner, to cause Mechanical Completion to occur by the Guaranteed Completion Date.

Guarantee of Timely Completion. Contractor warrants and guarantees that (1) the First Unit Delivery shall occur on or before the Guaranteed Unit Delivery Date of the First Unit, or November 15, 1999, and (2) the Second Unit Delivery shall occur on or before the Guaranteed Unit Delivery Date of the Second Unit, or December 31, 1999, but in no event shall such date be before September 1, 1999."
