HIGHWAY WORKS. 5.1 The Developer and the Trust covenant with the County Council not to Occupy the Development unless and until: 5.1.1 the Developer has entered into a Section 278 Agreement with the County Council and the RTPI Contractor for the Highway Works. 5.1.2 the Developer has constructed the Highway Works in accordance with the Section 278 Agreement and made them available for public use.
HIGHWAY WORKS. 2.1 All works and activities to be carried out under the terms of this Agreement (including for the avoidance of doubt such works as are of a preparatory ancillary or of a maintenance nature) are (save where expressly provided otherwise) to be at the sole expense of the Developer and at no cost to the County Council 2.2 No work on the Highway Works shall commence and no contract or contracts in respect of the construction of the Highway Works shall be let until full details of the Highway Works have been submitted to the Director and the Director has given his written approval to the Highway Works and for the avoidance of doubt this Agreement does not constitute the written approval required under this clause 2.3 The Developer shall provide all relevant notices to the County Council under the New Roads and Street Works Act 1991 and Traffic Management Act 2004, and any amendments thereof 2.4 Insofar as the County Council as Highway Authority is required by any legislation regulation direction or code of practice (including in particular but without prejudice to the generality of the foregoing the New Roads and Street Works Act 1991) to serve a notice or notices in respect of the Highway Works on undertakers or other persons the Developer shall comply with such requirement on behalf of the County Council before the Highway Works commence and shall thereafter assume on behalf of the County Council such responsibilities as follow on therefrom in particular during the construction of the Highway Works 2.5 The Developer shall give due consideration to adjoining owners and occupiers at all times and shall organise activities relating to the Highway Works in such a manner as to cause the least practicable disruption 2.6 The Developer shall display and maintain prominent notices around the perimeter of the Site to warn the public of the dangers of entering the Site. However the display of such notices shall not relieve the Developer of any of his obligations and liabilities under this Agreement, the Control of Pollution Act 1974 or the Environment Protection Act 1990, or any amendments thereof 2.7 The Developer shall take or procure the taking of all necessary steps to avoid creating a nuisance from noise and from dust and as far as practicable the Highway Works are to be carried out in such a way that noise and dust are kept to a minimum 2.8 When the Highway Works are being executed the Developer shall institute at his own expense measures previously approved in w...
HIGHWAY WORKS. The Promoter and City Council shall enter into a Highways Agreement in respect of the Highway Works at least 121 months prior to the Opening of the Memorial and Learning Centre. The Promoter and City Council shall enter into a Highways Agreement in respect of the Highway Works at least 24 months prior to the Opening of the Memorial and Learning Centre The Memorial and Learning Centre shall not be Opened unless and until: the Highway Works; and any other works required to the public highway arising as a result of the Outline Operational Security Management Plan or Detailed Operational Security Management Plan, have been Practically Completed.
HIGHWAY WORKS. The Developer hereby agrees to carry out and complete the Highway Works as agent for the Highway Authority and covenants that no building to be constructed on the Site shall be occupied until the Highway Works (including all works ancillary or incidental thereto) are completed in accordance with the stipulations requirements and conditions laid down in this Agreement
HIGHWAY WORKS. The Highways Works comprising the following works: Creation of new “Right Turn Lane” on Foxhall Road, Foxhall, East Suffolk, (nearest postcode: IP10 0AN) involving haunch to both north and south edges of existing carriageway, within existing highway boundary and amend existing access to Foxhall Recycling Centre. Details of the proposed layouts are illustrated within the accompanying drawings. Timescale: The Highway Works are to be substantially completed by December 2023 (Contractor to confirm)
HIGHWAY WORKS. The Owner covenants with the Council not to Occupy or permit Occupation of any New Dwelling until: the Highway Agreement has been completed; and the Junction Works have been completed to base course level. The restriction on Occupation set out in paragraph 1 of this Part 3 of Schedule 3 may be varied by agreement in writing between the Owner and the Council (acting reasonably) if the Owner demonstrates that despite using its reasonable endeavours it has been unable to enter into the Highway Agreement.
HIGHWAY WORKS. The Developer covenants with the Council and TfL: 2.1 Not to commence Above Ground Works until the Section 38/278 Highway Works Specification for the Council Section 38/278 Highway Works has been submitted to the Director of Planning and Growth and the Highway Development Manager and the Section 38/278 Highway Works Specification for the TfL Section 38/278 Highway Works has been submitted to TfL, and the Director of Planning and Growth, the Highway Development Manager and/or TfL (as appropriate) have approved such specifications in writing. 2.2 Not to commence the Section 38/278 Highway Works until the Developer has entered into the Section 38/278 Agreement with the Council in respect of the Council Section 38/278 Works and the Section 38/278 Agreement with TfL in respect of the TfL Section 38/278 Highway Works (and the Council and TfL hereby covenant to enter into the respective Section 38/278 Highway Agreements with the Developer) for the purpose of authorising the Section 38/278 Highway Works and securing them to the value of the Section 38/278 Highway Works Bond. 2.3 Not to Occupy the Development or any part of it until the Section 38/278 Highway Works detailed in the Section 38/278 Highway Works Specifications approved pursuant to paragraph 2.1 above have been completed in accordance with the relevant Section 38/278 Agreement to the reasonable satisfaction of the Director of Planning and Growth, the Highway Development Manager and/or TfL (as appropriate) unless alternative dates have been agreed in the relevant Section 38/278 Agreement or where it has been agreed that the relevant highway authority is undertaking the Section 38/278 Highway Works the Developer has paid the costs of these works to the relevant highway authority.
HIGHWAY WORKS. 5.1 The Developer covenants with the County Council not to Occupy the Development unless and until the Developer has entered into a Section 278 Agreement with the County Council and the RTPI Contractor for the Highway Works. ; and 5.2 The Developer covenants with the County Council not to Occupy more than 50% of the Care Units unless and until the Developer has constructed the Highway Works in accordance with the Section 278 Agreement and made them available for public use. 5.3 The Developer covenants with the County Council not to Occupy more than 50% of the Care Units the Development unless and until the Developer has: 5.3.1 submitted to the County Council the specification for the Development RTPI Display Works and obtained the County Council’s written approval thereto; 5.3.2 completedprovided the Development RTPI Display Works in accordance with the approved specification; and
HIGHWAY WORKS. 3.1 ▇▇▇ ▇▇▇▇▇▇▇▇▇▇ will carry out and complete the Highway Works as agent for the Highway Authority in accordance with the details approved pursuant to clause 13.2 and programmes of works agreed pursuant to clause X.X 3.2 ▇▇▇ ▇▇▇▇▇▇▇▇▇▇ shall having commenced the Highway Works proceed with them conscientiously and expeditiously and with all due diligence and shall complete the same in respect of each phase not later than [12 months] from the date of the commencement of the Highway Works for that particular phase or such alternative period agreed between the parties with completion of the works to be taken as the issuing of the provisional certificate by the Director pursuant to clause 4.1
HIGHWAY WORKS. 15.1 Party A shall be responsible for the highway works surrounding the Development as shown on the attached plan in accordance with its statutory obligations under the Highways Act 1980.
