Common use of Holiday Falling on Clause in Contracts

Holiday Falling on. a Day of Rest‌ When a paid holiday falls on an employee's day of rest, the Employer shall make every reasonable effort to give the employee a lieu day off with pay on the first regularly scheduled workday following the day of rest so affected. Where this is not possible, the lieu day shall be taken at a mutually agreeable time. When a paid holiday is moved to another day under the provisions of this Clause: (a) work performed by an employee on the day from which the holiday was moved shall be considered as work performed on a day of rest; and (b) work performed by an employee on the day to which the holiday was moved shall be considered as work performed on a holiday.

Where this is not possible, the lieu day shall be taken at a mutually agreeable time. A non-instructional day or an indirect instructional day is not a day of rest. When a paid holiday is moved to another day under the provisions of this Clause: (a) work performed by an employee faculty member on the day from which the holiday was moved shall be considered as work performed on a day of rest; and (b) work performed by an employee faculty member on the day to which the holiday was moved shall be considered as work performed on a holiday.
