Common use of Home Based Work Clause in Contracts

Home Based Work. (1) By agreement between the employer and the employee, flexible work arrangements may be available that provide the opportunity for an employee to work from home for agreed periods of their normal week. (2) In determining whether an employee may work from home, the decision is to be based on a proper assessment of the work-related requirements of the health service involved and identified employee requirements. This will include consideration of: (a) The effect the decision will have on client service and other workplace relationships; (b) The suitability of the particular position to this type of arrangement; (c) Whether implementation of the arrangement will be cost neutral; and (d) Whether or not the proposal generally meets the requirements of the employer’s policy on working from home. (3) The employer and the employee are both responsible for meeting occupational safety and health standards at the employee’s home workplace. (4) The employee must maintain, at all times the security, integrity and confidentiality of the employer’s intellectual, informational and physical property.
