HOW THIS COVERAGE APPLIES. This Employer's Liability Coverage applies to bodily injury by accident or bodily injury by disease, including resulting death, subject to the following conditions: 1. The bodily injury must arise out of and in the course of the injured employee's employment by the Member. 2. The employment must be necessary or incidental to the Member's work in the State of California. 3. Bodily injury by accident must occur during the coverage period. 4. Bodily injury by disease must be caused or aggravated by the conditions of employment. The employee's last day of exposure to the conditions causing or aggravating such bodily injury by disease must occur during the coverage period. 5. If the Member is sued, the suit and any related legal actions for damages for bodily injury by accident or by disease must be brought under the laws of the State of California.

  • Workers’ Compensation and Employer’s Liability Coverage The insurer shall agree to waive all rights of subrogation against the City, its directors, officials, officers, employees, agents and volunteers for losses paid under the terms of the insurance policy which arise from work performed by the Consultant.

  • Worker's Compensation and Employer's Liability Insurance The Contractor shall have in effect during the entire life of this Agreement Workers' Compensation and Employer's Liability Insurance providing full statutory coverage. In signing this Agreement, the Contractor certifies, as required by Section 1861 of the California Labor Code, that it is aware of the provisions of Section 3700 of the California Labor Code which requires every employer to be insured against liability for Worker's Compensation or to undertake self-insurance in accordance with the provisions of the Code, and I will comply with such provisions before commencing the performance of the work of this Agreement.
