Immediate Actions. A. Priority 1 IRAs
1. The Priority 1 IRA Areas are depicted in the attached maps (Attachments 1 and 2) and identified as follows:
a. City of Midland
i. Corning Lane
ii. Neighborhood North of Dow Facility iii. Neighborhood East of Corning Lane
b. Tittabawassee River Properties Residential properties where the home or yard close to the home was inundated during the March 2004 flood (a 7-10 year flood event)
2. The following Priority 1 IRAs must be completed/in place by December 31, 2005 or as provided for in an agreed upon schedule.
a. The Communications IRA prepared by Dow and as approved with modifications by DEQ will be implemented.
b. The attached IRA Work Plans issued by DEQ for the City of Midland (Attachment 3) and Tittabawassee River Floodplain (Attachment 4) areas identified above will be implemented by Dow.
Immediate Actions. The present report was discussed at a meeting between the EEA project team and representatives from CMEMS, CAMS, C3S, ESA and EUMETSAT on 4 October 2019. Three activities that could be started immediately were identified:
Immediate Actions. Use of Building 27 Instead of Expanding the Yakima Competency Restoration Center
a. Parties agree that the Yakima Competency Restoration Center (hereinafter “YCRC”) will not be expanded. Instead, subject to approval of all necessary permits and licensing requirements, space currently leased for the provision of evaluation and treatment services through December 5 2017 in one half of Building 27 (hereinafter “Building 27 space”) on the grounds of Western State Hospital will be used to serve class members.
b. Defendants will use funds intended for the YCRC expansion for the operation of the Building 27 space, contingent on approval of all necessary permits and licensing requirements and on the Court authorizing contempt fines to cover necessary construction costs. If the Court does not authorize contempt fines to be used for this purpose, Defendants will not be obligated under this Agreement to operate services for class members in Building 27, will not be restricted under this Agreement from pursuing expansion at YCRC, and Parties will meet to consider whether an alternative agreement can be reached.
c. The Parties agree to utilize the renovation process developed by the Court Monitor in coordination with AustinCina architectural firm (hereinafter the “Monitor’s Plan”). See Building 27 space Timeline provided by Court Monitor, and attached as Attachment A. In order to open beds in the Building 27 space in accordance with the Monitor’s Plan before the 18 conclusion of the Systems Improvement Agreement at Western State Hospital, the Parties agree that Building 27 will be licensed and operated as a Residential Treatment Facility (the 20 same licensure and model employed at YCRC and Maple Lane). However, instead of contracting to a third party for the provider services, the Department will operate and manage the Building 27 Residential Treatment Facility (hereinafter “RTF”). The Department agrees to hire the staff necessary to be ready to operate Building 27 as an RTF. Nothing in this 1 Agreement prevents or limits the authority of the Department from contracting, in accordance 2 with statutory and collective bargaining requirements, for services needed to operate Building

Immediate Actions. After the execution of this SA, the Parties agree to work quickly and negotiate in good faith to finalize the supporting agreements pursuant to the terms and conditions outlined in this document. Each Party agrees to act with prudent haste to enter into the Agreements regarding the Parties mutual objectives. The Parties agree to sign the Agreements which reflect the terms and conditions reflected in this Services Agreement within forty five days (45) after signing this document.
