Immediate Suspension. 15 16.7.1 Nothing herein shall preclude the District from effectuating an immediate suspension with 16 subsequent action pursuant to Section 16.5 of this Article when reasonable cause exists to believe 17 that the unit member's presence at work could prove to be harmful or injurious to the District. Prior 18 to affecting an immediate suspension by the Superintendent or the Director of Human Resources, the 19 unit member shall be given notice of such proposed suspension, the reason for proposed suspension, 20 and the opportunity to respond. This notice and the opportunity to respond shall be in writing. Such 21 suspension shall be with pay if the dismissal is subsequently overruled. 22 16.7.2 Any unit member charged with the commission of any sex offense as defined in Education 23 Code Section 44010 or any narcotics offense as defined in Section 44011 of the Education Code by 24 complaint, information or indictment filed in a court of competent jurisdiction, may be suspended as 25 provided for in Section 45304 of the Education Code.
