Common use of Immediate Threats Clause in Contracts

Immediate Threats. If, in the determination of Chicago VPS, acting reasonably, the Equipment or customer poses an immediate threat to the physical integrity of the Premises or the physical integrity or performance of the equipment of Chicago VPS or any other user of the Premises, or poses an immediate threat to the safety of any person, then Chicago VPS may perform such work and take such other actions that it may consider necessary without prior notice to Customer and without liability for damage to the Equipment or for any interruption of Customer’s (or its clients’) businesses. As soon as practicable after performing such work, Chicago VPS shall advise Customer in writing of the work performed or the action taken.
