Common use of Improved Opportunity Clause in Contracts

Improved Opportunity. Those changes in assignment made for the purpose of moving an employee from a position in which he/she is not successful, according to unsuccessful evaluations, to one in which he/she has an improved opportunity for success. In such cases (improved opportunity transfers), the District is given authority to act in the best interest of the District and the employee with regard to the assignment, which includes the right to waive 3.a and 3.b above.
