Common use of INCORRECT STATEMENTS Clause in Contracts

INCORRECT STATEMENTS. Any statement made by any of the Obligors in SECTION 14 or in any document delivered pursuant to this Agreement is incorrect in any material respect when made or deemed to have been repeated; provided that, if any statement deemed to have been made by the Obligor pursuant to SECTION 14(3) shall have been incorrect solely by reason of the existence of a Termination Event or Potential Termination Event of which the Obligor was not aware when such statement was deemed to have been made and which was cured before or promptly after the Obligor became aware thereof, then such statement shall be deemed not to have been incorrect in any material respect.

INCORRECT STATEMENTS. Any statement made by any of the Obligors in SECTION 14 16 or in any document delivered pursuant to this Agreement is incorrect in any material respect when made or deemed to have been repeated; provided that, if any statement deemed to have been made by the Obligor pursuant to SECTION 14(316(3) shall have been incorrect solely by reason of the existence of a Termination Event or Potential Termination Event of which the Obligor was not aware when such statement was deemed to have been made and which was cured before or promptly after the Obligor became aware thereof, then such statement shall be deemed not to have been incorrect in any material respect.
