Common use of INDEMNIFYING THE RAILWAY ADMINISTRATION Clause in Contracts

INDEMNIFYING THE RAILWAY ADMINISTRATION. 1. The Railway Administration shall not be responsible for any transactions in any manner between contractor and any third party and is not liable for consequential damages or compensation nor binding to any conditions what so ever. The contractor shall be responsible to indemnify the Railway Administration in case of any damages claimed for any injury or what so ever sustained by any third party or Railway personnel of any act of omission or commission by the contractor or his agents or found liable to compensate by any authority or court of law. The amount as falling due on such claims or as per agreement clause may be lawfully recoverable from his bills / security deposit. 2. The contractor shall indemnify Railway Administration against any claims, damages, loss or penalty including costs thereof in case of liability arising out of any accident / incident or loss of life involving manpower deployed by the contractor. 3. The contractor shall indemnify Railway Administration against any claims, damages, loss or penalty including costs thereof arising out of any breach or violation of any of the provisions of various acts enacted by the Central / State Governments, such as payment of wages act, workmen’s compensation act, hours of employment regulation act, employment of children acts, etc., as applicable from time to time, governing the employees employed by the contractor.
