Common use of Indirect Network Connection Clause in Contracts

Indirect Network Connection. 3.3.1.1 Indirect Network Connection in intended only for de minimis traffic associated with BendTel “start-up” market entry into a CenturyLink local exchange. Therefore Indirect Network Interconnection will be allowed only on routes between CenturyLink end offices and a BendTel switch in instances where, and only so long as, none of the triggers set forth in Section 3.3.2.4 of this Article have been reached. 3.3.1.2 Indirect Network Connection shall be accomplished by CenturyLink and BendTel each being responsible for delivering Local Traffic to and receiving Local Traffic at the ILEC Tandem Switch serving the CenturyLink end office. Each Party is responsible for the facilities to its side of the tandem. Each Party is responsible for the appropriate sizing, operation, and maintenance of the transport facility to the tandem. 3.3.1.3 The Parties agree to enter into their own agreements with third- party providers. In the event that BendTel sends traffic through CenturyLink’s network to a third-party provider with whom BendTel does not have a traffic interexchange agreement, then BendTel agrees to indemnify CenturyLink for any termination charges rendered by a third-party provider for such traffic.

Therefore Indirect Network Interconnection will be allowed only on routes between CenturyLink CenturyTel end offices and a BendTel **CLEC switch in instances where, and only so long as, none of the triggers set forth in Section 3.3.2.4 of this Article have been reached. 3.3.1.2 Indirect Network Connection shall be accomplished by CenturyLink CenturyTel and BendTel **CLEC each being responsible for delivering Local Traffic to and receiving Local Traffic at the ILEC Tandem Switch serving the CenturyLink CenturyTel end office.
