Information and Confidentiality. 13.1 The Customer will provide HBT with any information which HBT may reasonably require to enable to proceed with the performance of its obligations under this Contract. 13.2 The Customer acknowledges that HBT reserves the right to review or edit any of the Customer's information (including but not limited to information about the communications such as origin, destination, duration, route and time) or third party information which the Customer uses in connection with the Services for the purposes of any of the following: 13.2.1 performing its obligations under this Contract; 13.2.2 correcting, maintaining and improving the Services; 13.2.3 ensuring that the Customer is complying with the Acceptable Use Policy; 13.2.4 monitoring the performance of the Services including the Customer's usage; 13.2.5 collating information to provide non-specific statistics to assist in HBT’s business planning; 13.2.6 complying with applicable laws, regulations and statutory instruments; or 13.2.7 complying with any request for information or disclosure from a Court or other appropriately authorised body. 13.3 Neither party shall disclose to any third party without the prior written consent of the other party any Confidential Information which is received from the other party as a result of this Contract. Each party agrees that any Confidential Information received by it from the other party shall only be used for the purposes of the performance of its obligations and/or the exercise of its rights. 13.4 These restrictions shall not apply to any information which is or becomes generally available to the public other than as a result of a breach of an obligation under this clause 13, is acquired from a third party who owes no obligation of confidence in respect of the information, has been independently developed by the recipient, or is required by any Court of competent jurisdiction or by a governmental or regulatory authority or where there is a legal right, duty or requirement to disclose such Confidential Information.

13.2 The Customer acknowledges that HBT reserves the right to review Agreement or edit any of the Customer's information (including but not limited to information about the communications such as origin, destination, duration, route and time) or third party information which the Customer uses in connection with the Services for the purposes of any of the following:
13.2.1 performing its obligations under this Contractrelated agreements;
13.2.2 correcting, maintaining and improving the Services;
13.2.3 ensuring that the Customer any matter which a Party can demonstrate is complying with the Acceptable Use Policy;
13.2.4 monitoring the performance of the Services including the Customer's usage;
13.2.5 collating information to provide non-specific statistics to assist in HBT’s business planning;
13.2.6 complying with applicable laws, regulations and statutory instruments; or
13.2.7 complying with any request for information or disclosure from a Court or other appropriately authorised body.
13.3 Neither party shall disclose to any third party without the prior written consent of the other party any Confidential Information which is received from the other party as a result of this Contract. Each party agrees that any Confidential Information received by it from the other party shall only be used for the purposes of the performance of its obligations and/or the exercise of its rights.
13.4 These restrictions shall not apply to any information which is or becomes already generally available to and in the public other domain otherwise than as a result of a breach of an obligation this Clause 13;
13.2.3 any disclosure to enable a determination to be made under Clause 18 (Dispute Resolution);
13.2.4 any disclosure of information which is already lawfully in the possession of the receiving party, prior to its disclosure by the disclosing party;
13.2.5 any disclosure by e|net to the Contracting Authority or its representatives of information relating to the this clause 13Agreement and such other information as may be reasonably required; or
13.2.6 any registration or recording of any Necessary Consents and property registration;
13.2.7 any disclosure for the purpose of;
(a) the examination and certification of Customer’s or e|net’s accounts; or
(b) any examination pursuant to Legislation; or
(c) any examination which may be required pursuant to or in connection with Parliamentary requirements; or
(d) in compliance with the order of a court or tribunal of competent jurisdiction.
13.3 Where disclosure is permitted under Clause 13.2, is acquired from a third party who owes no other than Clauses 13.2.5 and 13.2.7 the recipient of the information shall be subject to the same obligation of confidence confidentiality as that contained in respect this Agreement.
13.4 Neither Party shall make use of this Agreement or any Confidential Information or Commercially Sensitive Information issued or provided by or on behalf of the informationother Party in connection with this Agreement otherwise than for the purpose of this Agreement, has been independently developed by except with the recipientwritten consent of that other Party. Customer acknowledges that an executed copy of this Agreement shall be provided to the Contracting Authority at the Contracting Authority’s request.
13.5 So far as practicable, or is required by the Parties shall designate as Confidential Information and/or as Commercially Sensitive Information, any Court information transmitted between each other which they believe to be of competent jurisdiction or by a governmental or regulatory authority or where there is a legal right, duty or requirement such character. Confidential Information and Commercially Sensitive Information transmitted between the parties shall be deemed to disclose such Confidential Informationbe on foot of an agreement as to confidentiality within the meaning of Section 26(1)(b) of the Freedom of Information ▇▇▇ ▇▇▇▇.

Each party agrees that any Confidential Information received by which it from the other party shall only be used for the purposes of becomes aware in the performance of its obligations and/or the exercise of its rights.this Agreement unless:
13.4 These restrictions shall not apply 23.1.1 such information is required to any information which is or becomes generally available be disclosed to the respective financiers of CTI or BDB, to members of their respective Groups or their shareholders, subject in each case to such companies or individuals agreeing that the information shall be confidential in terms substantially similar to this Clause 23.1;
23.1.2 such information is public knowledge, or subsequently becomes public knowledge, other than as a result of a by breach of an obligation under this clause 13, is acquired Agreement;
23.1.3 such information subsequently comes lawfully into the possession of the party in question from a third party who owes no obligation party; or
23.1.4 the disclosure of confidence in respect of the information, has been independently developed by the recipient, or such information is required pursuant to law, by any Court court of competent jurisdiction or by a governmental any regulatory authority, including any recognised stock exchange or regulatory authority or where there any taxation authority.
23.2 To the extent that it is a legal right, duty or requirement necessary to disclose confidential information pursuant to the provisions of this Clause 23.2 or otherwise as is necessary to implement the provisions of this Agreement, either party may disclose any confidential information concerning this Agreement to its employees, agents, professional advisers or authorised sub-contractors on a "need-to-know basis"; provided that before any such Confidential Informationdisclosure such party shall make such persons aware of its obligations of confidentiality under this Agreement and shall at all times procure compliance by such persons with these obligations of confidentiality as if they were party to their Agreement.
23.3 CTI may not refer to this Agreement in any publicity or advertising material without first obtaining BDB's written consent.

Each party agrees that any Confidential Information received by it from the other party shall only be used for the purposes of the performance of its obligations and/or the exercise of its rights.
13.4 14.4 These restrictions shall not apply to any information which is or becomes generally available to the public other than as a result of a breach of an obligation under this clause 1314, is acquired from a third party who owes no obligation of confidence in respect of the information, has been independently developed by the recipient, or is required by any Court of competent jurisdiction or by a governmental or regulatory authority or where there is a legal right, duty or requirement to disclose such Confidential Information.

Each party agrees that any Confidential Information received by which it from the other party shall only be used for the purposes of becomes aware in the performance of this Agreement unless:
19.1.1 such information is required to be disclosed to CTI's bankers, CTI's holding company and any shareholders of its holding company (subject in each case to such companies or individuals agreeing that the information shall be confidential in terms substantially similar to this Clause 19.1); or
19.1.2 such information is public knowledge, or subsequently becomes public knowledge, other than by breach of this Agreement; or
19.1.3 such information subsequently comes lawfully into the possession of the party in question from a third party; or
19.1.4 the disclosure of such information is required by any court of competent jurisdiction or any regulatory authority, including any recognized stock exchange or any taxation authority.
19.2 To the extent that it is necessary to disclose confidential information pursuant to the provisions of this Clause 19 or otherwise as necessary to implement the provisions of this Agreement, either party may disclose any confidential information concerning this Agreement to such of its employees or, in the case of the BBC, to such of the BBC's nominated contractor(s) as may be reasonably necessary on a "need-to-know basis", provided that before any such disclosure such party shall make such persons aware of its obligations and/or the exercise of its rightsconfidentiality under this Agreement and shall at all times procure compliance by such persons therewith.
