Subject to Clause[s 9.3 and] 9.5Clause 14.4, the Parties each Party shall keep confidential and shall not disclose any information relating to the affairs of any the other Party which it obtains pursuant to this Agreement, other than information information: 14.3.1. which at the time of disclosure is in the public domain, or thereafter becomes part of the public domain or otherwise than as a consequence of a breach by a Party of its obligations under this Clause 14; 14.3.2. which it also obtains (other than under a duty of confidence) other than pursuant to this Agreement, and save to the extent to ; 14.3.3. which it is required to disclose such information to any government department or any governmental or regulatory agency having jurisdiction over any Party (including but not limited to the Gas and Electricity Markets Authority), or as required by law.law or any lawful subpoena or recognised stock exchange or other process in connection with any judicial arbitration or administrat ion proceeding; 9.5 14.4. National Grid Gas shall own all information relating to the quantities in in, or rate at which gas is offtaken from the National Transmission System at the Premises Supply Meter Point which is obtained by means of any equipment specified in Annex CSchedule 1 Part II, it being acknowledged that that, subject always to Clause 9.4 14.3, a Party may at all times use such information freely in relation to that Party’s business. National Grid Gas may disclose such information to the Authority, the Operator [ABC] and each Relevant Shipper Registered User and any third party, but in the latter case only with the written consent of the other Parties[ABC], such consent not to be unreasonably withheld. 9.6 In the event of any 14.5. If there is a conflict between information provided by a Relevant Shipper Registered User and information provided by the Operator[ABC], (save where such information is provided by the Operator [ABC] pursuant to Annex D or F Schedule 4 or to the procedures referred to in Clause 109, in which case National Grid Gas shall rely on the information provided by the Operator[ABC]) National Grid Gas shall rely on that information provided by a Relevant ShipperRegistered User. 9.7 14.6. The obligations of any Party pursuant to this Clause 9, 14 shall continue for a period of 5 years from the date that it ceases to be a Party.
