Initial Determination. The Insurance Administrator shall have exclusive authority to determine a claimant's eligibility for Section 207-c Benefits. Whenever circumstances permit, the Insurance Administrator will make an initial determination concerning a claimant's eligibility for Section 207-c benefits within sixty (60) calendar days of receipt of the application for benefits. However, failure of the Insurance Administrator to make a determination within sixty (60) calendar days shall not qualify the claimant for 207-c benefits by default.
