Installation and Functioning. MiSANTO offers You access to and the right to use the MiSANTO-App for your own personal purposes (but not to re-sell or re-license them to other Users). Once you have installed the MiSANTO-App yourself, the MiSANTO-App allows You to upload and share any health-re- lated information relevant to You with third parties chosen by You such as other Users or Health Professionals. Please be aware that - You must always use the latest version of the MiSANTO-App for the configuration and interaction between the items to work (as announced in the relevant App Store); - You also need a Google Play-Store account (for Android) or Apple ITunes-Store ac- count (for IoS) in order to download and update the MiSANTO-App. You acknowledge and confirm that you will comply with the applicable provisions of the Google Play-Terms of Service and/or Apple ITunes-Terms of Service regarding down- load and use of the MiSANTO-App and acknowledge that those provisions may ap- ply in addition to these Terms of Use; - We only offer the MiSANTO-App as a self-executing software application “as is”, i.e. without representations and warranties or liabilities of any kind. In particular, MiSANTO does not offer the electronic transmission of information (telecommuni- cation services). This is the task of the telecommunication service provider you are served by under your current subscription of the respective device. MiSANTO does not assume any responsibilities of any kind with regard to telecommunication ser- vices for You and is not a telecommunication service provider. MiSANTO does not offer support relating to errors/issues which occur in the ordinary exe- cution and/or presentation of the MiSANTO-App or which are related to programs sur- rounding the hardware or software involved in the use of the MiSANTO-App (that is to say programs which are not attributed to MiSANTO and are thus not in the sphere of influence of MiSANTO). This particularly, but not only, applies to errors/issues which occur due to the rules and settings of User’s IT security or User’s outdated operating system. Any liability of MiSANTO for such cases is expressly excluded.

Related to Installation and Functioning

  • Installation and Use You may install and use the Software only for the number of licenses acquired by you. In order to exercise your rights to the Software under this Agreement, you must activate your copy of the Software in the manner described during the launch sequence.

  • Installation When installation is required, the Contractor shall be responsible for placing and installing the Commodities or parts in the required locations at no additional charge. All materials used in the installation shall be of good quality and shall be free of defects that would diminish the appearance of the Commodity or render it structurally or operationally unsound. Installation includes the furnishing of any equipment, tools, rigging, labor, and materials required to install or replace the Commodities or parts in the proper location. Contractor shall protect the site from damage and shall repair damages or injury caused during installation by Contractor or its employees or agents. If any alteration, dismantling, excavation, etc., is required to achieve installation, the Contractor shall promptly restore the structure or site to its original condition. Contractor shall perform installation work so as to cause the least inconvenience and interference with Customers and with proper consideration of others on site. Upon completion of the installation, the location and surrounding area of work shall be left clean and in a neat and unobstructed condition, with everything in satisfactory repair and order.

  • Installation, Maintenance, Testing and Repair Unless otherwise agreed in writing by the Parties, to the extent required by Applicable Law, Interconnection provided by a Party shall be equal in quality to that provided by such Party to itself, any subsidiary, affiliates or third party. If either Party is unable to fulfill its obligations under this Section 14.2, it shall notify the other Party of its inability to do so and will negotiate alternative intervals in good faith. The Parties agree that to the extent required by Applicable Law, the standards to be used by a Party for isolating and clearing any disconnections and/or other outages or troubles shall be at parity with standards used by such Party with respect to itself, any subsidiary, affiliate or third party.

  • Installation and Maintenance Except for the bi‐directional and production metering equipment owned by the City, all equipment on Customer’s side of the delivery point, including the required disconnect device, shall be provided and maintained in satisfactory operating condition by Customer and shall remain the property and responsibility of the Customer. The City will bear no responsibility for the installation or maintenance of Customer’s equipment or for any damage to property as a result of any failure or malfunction thereof. The City shall not be liable, directly or indirectly for permitting or continuing to allow the interconnection of the Facility or for the acts or omissions of Customer or the failure or malfunction of any equipment of Customer that causes loss or injury, including death, to any party.

  • Installation Services The Bitstream 2a Service includes a Standard Install as set out below (in each case to the extent that the relevant provisioning works are not already complete for the relevant Service Order).1
