Common use of INSTALLATION TIME PERIOD Clause in Contracts

INSTALLATION TIME PERIOD. From Monday through Friday of each week during the term of this contract, the Contractor will be issued groups of orders for the installation and/or scarification of markings. In the event that field conditions are different from the Work Orders the Contractor shall notify the Engineer and if warranted, the Engineer shall supply the Contractor with additional supplemental Work Orders detailing the differing field conditions. Within 10 (ten) days of receipt of a Work Order or a group of Work Orders, the contractor shall commence performance of the required work. In the event that the contractor cannot commence work on a Work Order or group of Work Orders, within 10 (ten) days he/she must inform the Engineer and state the reason for the delay. The Engineer's decision to accept or reject the reason(s) for the delay shall be binding and conclusive on the contractor. The contractor is required to install a minimum of 50,000 linear feet of thermoplastic and 10,000 square feet of Pavement Color System markings per week except during the period from November 15 to April 1. The Engineer may, at his/her sole discretion, on written request from the Contractor, extend the completion time for a location by the number of days the Contractor was unable to work due to climatic conditions.
