INSTRUCTION TO BIDDERS. 39.1 Contractors shall not engage employees of other contractors presently working in MDL & recorded at Security Dept. The contractor can engage such employee if other contractor gives No Objection Certificate for such engagement & cancel the name of such desirous employee from his roll & accordingly convey to Security. The contractor engaging such employee without permission is liable for penalty including termination of contract & forfeiture of Security Deposit. Such penalty can also be imposed if it is observed that supervisors/ Workers deployed by contractor are not on their roll as per statement submitted by him at Security.

40.2 The bidder / supplier / contractor declares that they being proprietors / directors / partners have not been any time individually or collectively blacklisted or banned or de-listed by any Government or quasi Government agencies or PSUs. If a bidder’s entities as stated above have been blacklisted or banned or de-listed by any Government or quasi Government agencies or PSUs, this fact must be clearly stated and it may not necessarily be a cause for disqualifying him.

40.4 In the event of placement of order on unregistered vendor, the firm shall apply for registration through Smt. ▇▇▇▇▇ ▇▇▇▇▇▇, CM, SR&R dept., Tel. No. ▇▇▇▇▇▇▇▇, within one month from placement of order.
40.5 MDL reserves the right to consider placement of Order / Contract in part or in full against the tendered quantity or reject any or all bids or to cancel the tender without assigning any reason.
40.6 In case of the performance of the contractor is not satisfactory, MDL reserves the right to cancel the order.
40.7 In case of proper on-line filling of Acceptance Formats for SLA, General conditions of contract (GCC) for Goods & Services, it shall be presumed that all our tender terms & conditions are acceptable to you.

INSTRUCTION TO BIDDERS. The selection of services will be based on Least Cost Selection Method through Single Stage Two Envelopes bidding procedure.
a) The bid shall be submitted through E-tendering portal under Qualification (Eligibility), Technical and Financial/Commercial envelopes with all the supporting documentary evidence.
b) In the first instance, qualification envelope shall be opened to ascertain the eligibility of the bidder as per the eligibility criteria on e-tendering portal.
c) Technical Envelope comprising of “Technical Proposal” shall be opened for eligible bidders on E-tendering portal.
d) PSDF shall evaluate Technical Proposals in a manner prescribed in section–09 and Technical Envelope available on the portal, without reference to the price and condition shall reject any proposal which does not conform to specified requirements.
e) During the technical evaluation, no amendments to Technical Proposal shall be permitted.
f) After the evaluation and approval of the technical proposals, the Financial/ Commercial Envelope comprising of financial proposal shall be opened for technically responsive bids, publicly at a time, date and venue announced and communicated to the bidders in advance, within the Bid validity period.
g) The financial bids found technically non-responsive shall be rejected.
h) The Technical (Qualification & Technical Envelopes) and Financial (Commercial Envelope) Proposals shall be evaluated based on PSDF’s evaluation criteria as provided in section 03, 09 and 11 of the bidding document and envelopes available on portal.
i) This document has different sections carrying information on eligibility, technical evaluation, Scope of work, conditions of tender and form of contract, etc. to assist potential bidders to develop their Technical Proposals. Bidders those found eligible and qualifying in technical evaluation shall be invited for financial bid opening.
j) Minimum passing marks are 65, a bidder who obtains a minimum of 65 marks or more shall be marked as technically qualified and shall be considered for financial bid opening.
k) The bidding procedure shall be governed strictly in accordance with the applicable procurement rules.

Bidder shall create a process document for carrying out the LABORATORY TESTING from NABL ACCREDITED LABORATORIES and submit the same to ICMR-NITM within 7 days of the award of the contract. 2.1.4. Escalation matrix shall be given for the staff and other activities so that backup supports be available.
2.1.5. The selected Company/bidder shall not, without ICMR-NITM’s prior written consent, disclose the contract, or any provision thereof, of any specification, plan sample of information furnished by or on behalf of ICMR-NITM in connection therewith, to any person other than a person employed by the SP in the performance of the contract. Disclosure to any such employed person shall be made in confidence and shall extend only as far as may be necessary for purposes of such performance.
2.1.6. All empaneled companies automatically agree with ICMR-NITM for honoring all aspects of fair-trade practices in executing the work orders placed by ICMR-NITM.
2.1.7. ICMR-NITM will process the bid as per the procedures mentioned in the tender document. It, however, reserves the right to reject any bid without assigning any reason. ICMR-NITM would not be under obligation to give any clarifications to those agencies whose bids have been rejected.
2.1.8. ICMR-NITM reserves the right to modify and amend any of the tender conditions/criteria depending upon Project priorities vis-à-vis urgent commitments. ICMR-NITM also reserves the right to cancel this bid without assigning any reason.
