Instructors. 7.1. All instructors teaching COLLEGE’s courses offered as part of this CCAP Agreement must meet the minimum qualifications for instruction in a California community college as set forth in Sections 53410 and 58060 of Title 5 of the California Code of Regulations, and be hired by the CLPCCD. 7.2. The CCAP Agreement Appendix shall specify which participating TUSD or COLLEGE will be the employer of record for sole and limited purposes of assignment monitoring and reporting to the county office of education. 7.3. This CCAP Agreement specifies the TUSD will assume reporting responsibilities pursuant to applicable federal teacher quality mandates. 7.4. Instructors who teach COLLEGE’s courses offered as part of this CCAP Agreement must provide the supervision and control reasonably necessary for the protection of the health and safety of students and may not have any other assigned duty during the instructional activity. 7.5. Instructors who teach COLLEGE’s courses at TUSD shall comply with the fingerprinting requirements set forth in Education Code section 45125.1, and the tuberculosis testing and risk assessment requirements of California Health and Safety Code section 49406. In addition to any other prohibition or provision, no person who has been convicted of a violent or serious felony shall be eligible to teach any courses offered as part of this CCAP Agreement or otherwise provide services on a TUSD site. 7.6. Prior to teaching, faculty provided by the TUSD shall receive discipline-specific training and orientation from COLLEGE regarding, but not limited to, course curriculum, assessment criteria, pedagogy, course philosophy, testing and grading procedures record keeping, and other instructional responsibilities. Said training shall be approved by and provided by the COLLEGE. 7.7. Faculty provided by the TUSD will participate in professional development activities sponsored by COLLEGE as required by the terms and condition of the contract and shall be encouraged to participate in ongoing collegial interaction to include, but not limited address course content, course delivery, assessment, evaluation, and/or research and development in the field. 7.8. Faculty performance shall be evaluated by COLLEGE using the adopted evaluation process and standards for faculty of the COLLEGE, subject to the approval of CLPCCD. 7.9. COLLEGE may select instructors from TUSD personnel. TUSD personnel selected to be instructors remain employees of the TUSD, subject to the authority of the TUSD, but will also be subject to the direction of CLPCCD specifically with regard to instruction and assessment provided for the COLLEGE courses.

Instructors. 7.18.1. 7.28.2. Consistent with the terms negotiated between NVCCD and the COLLEGE faculty association, instructors for courses offered as part of this CCAP Agreement shall be assigned as follows: • Courses will first be offered to regular faculty of NVCCD that meet the above- stated minimum qualifications and have participated. • If courses are not filled by regular faculty, they will be offered to NVCCD adjunct faculty who possess contractual rehire preference rights, and who meet the above-stated minimum qualifications. • If courses are still not filled, they may be offered to employees of NVUSD who meet the above-stated minimum qualifications. NVUSD personnel selected to be instructors remain employees of NVUSD, subject to the authority of NVUSD, but will also be subject to the authority of NVCCD specifically with regard to their duties as instructors.
8.3. COLLEGE shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty who are NVCCD employees. NVUSD shall be solely responsible for the salaries, wages, and benefits due to the dual enrollment faculty who are NVUSD employees, unless otherwise agreed by NVUSD and NVCCD.
8.4. The CCAP Agreement Appendix shall specify which participating TUSD NVUSD or COLLEGE NVCCD will be the employer of record for sole and limited purposes of assignment monitoring and reporting to the county office of education. AB 288 Sec. 2 (m) (1)
8.5. NVCCD shall determine the number of instructors, the ratio of instructors to students, and the subject areas of instruction.

7.2. 7.3 Supplemental instruction related to the material presented in classes conducted under this Agreement by COLLEGE employees, which extends beyond the college schedule, is the SCHOOL DISTRICT’s responsibility.
7.4 The CCAP Agreement Appendix shall specify which participating TUSD or COLLEGE will be the employer of record for sole and limited all community college-paid faculty teaching at the SCHOOL DISTRICT.
7.5 SCHOOL DISTRICT or COLLEGE will be selected as the Employer of Record for purposes of assignment monitoring and reporting to the county office of education.. Sec. 2 (m) (1)

7.3 WVMCCD shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty who are WVMCCD employees. The CUHSD shall be solely responsible for the salaries, wages, and benefits due to the dual enrollment faculty who are CUHSD employees, unless otherwise agreed by CUHSD and WVMCCD.
7.4 The CCAP Agreement Appendix A shall specify which participating TUSD institution, either CUHSD or COLLEGE WVMCCD, will be the employer of record for sole and limited purposes of assignment monitoring and reporting to the county office of education. (Ed. Code § 76004 (m)(1).)

7.4. 7.6 Instructors who teach COLLEGE’s courses offered as part of this CCAP Agreement must provide the supervision and control reasonably necessary for the protection of the health and safety of students and may not have any other assigned duty during the instructional activity. In the event of an emergency during the teaching of a course, instructors will act in accordance with WVMCCD policies, procedures and code of conduct and inform CUHSD as soon as reasonably possible. If the course is held on CUHSD property, instructors shall follow the direction of the Principal or his/her designee to coordinate the safety of the students in attendance during the emergency.
7.5. 7.7 Instructors who teach COLLEGE’s courses at TUSD under this CCAP Agreement shall comply with the fingerprinting requirements set forth in Education Ed Code section 45125.1, and 45125 or as amended; the tuberculosis testing and risk assessment requirements of California Health and Safety Code section121525 or as amended; completion of training on mandated reporting as set forth in Education Code section 4940644691or as amended; and submission of a New Employee Data Input Form (i.e., Emergency Contact Information). In addition to any other prohibition or provision, no person who has been convicted of a violent or serious felony felony, as defined by Education Code section 44332.6 (c) shall be eligible to teach any courses offered as part of this CCAP Agreement or otherwise provide services on a TUSD CUHSD site. The CCAP Agreement Appendix shall specify additional procedures for faculty under this agreement.
7.6. 7.8 Prior to teaching, faculty provided by the TUSD CUHSD shall receive discipline-specific training and an orientation from WVMCCD at COLLEGE regarding, but not limited to, course curriculum, assessment criteria, pedagogy, course philosophy, testing and grading procedures record keeping, and other instructional responsibilities. Said training shall be approved by WVMCCD. In the event WVMCCD and provided by CUHSD disagree regarding faculty training guidelines, the COLLEGEparties agree to meet and confer in good faith. If the parties cannot reach agreement within a reasonable time, WVMCCD shall make the final decision regarding the appropriate training and orientation for CUHSD faculty.
7.7. 7.9 Faculty provided by the TUSD will CUHSD may participate in professional development activities sponsored by COLLEGE as required by the terms and condition of the contract WVMCCD and shall be encouraged to participate in ongoing collegial interaction to include, but not limited activities address items such as address course content, course delivery, assessment, evaluation, and/or research and development in the field.
7.8. 7.10 Faculty performance of all instructors, regardless of whether they are WVMCCD or CUHSD employees shall be evaluated by COLLEGE WVMCCD using the adopted evaluation process and standards for faculty of the COLLEGEWVMCCD. In conducting the evaluation, WVMCCD will provide CUHSD the opportunity to provide input. Such input will be given reasonable consideration.
7.11 WVMCCD shall determine the number of instructors, the ratio of instructors to students, and the subject areas of instruction, subject to approval by CUHSD. In the approval event of CLPCCDany disagreement, the parties agree to meet and confer in good faith. If the parties do not reach agreement, WVMCCD shall make the final determination.
7.9. COLLEGE may select instructors from TUSD personnel. TUSD personnel selected to be instructors remain employees of the TUSD, subject to the authority of the TUSD, but will also be subject to the direction of CLPCCD specifically with regard to instruction and assessment provided for the COLLEGE courses.

7.4 COLLEGE and SCHOOL DISTRICT must individually designate an employee to coordinate efforts to comply with and carry out each entity’s responsibilities under Title IX of the Education Amendments of 1972. Upon receipt of a complaint alleging harassment, discrimination or any other violation of law, including but not limited to Title IX, the designated employee from the entity receiving the complaint shall inform and provide a copy of such complaint to the designated employee from the other entity. The designated employees from the COLLEGE and SCHOOL DISTRICT shall review the facts giving rise to the complaint and determine which entity will take the lead on investigating, managing and resolving such complaint. Neither COLLEGE nor SCHOOL DISTRICT may abandon or assign their obligations under the law, including Title IX.
7.4. 7.5 Instructors who teach COLLEGE’s COLLEGE courses offered as part of this CCAP Agreement must provide the supervision and control reasonably necessary for the protection of the health and safety of students and may not have any other assigned duty during the instructional activity.
7.5. 7.6 Instructors who teach COLLEGE’s COLLEGE courses at TUSD shall comply with the fingerprinting requirements set forth in Ed Code § 45125 and/or Education Code section 45125.1, Section 87013 as amended and the tuberculosis testing and risk assessment requirements of California Health and Safety Code section 49406§ 121525 and/or Education Code Section 87408.6 as amended. In addition to any other prohibition or provision, no person who has known to have been convicted of a violent or serious felony shall be eligible to teach any courses offered as part of this CCAP Agreement or otherwise provide services on a TUSD SCHOOL DISTRICT site. Instructors shall be employed in accordance with Education Code Sections 87405 et seq. when the COLLEGE is designated the employer of record.
7.6. 7.7 Faculty will complete mandatory training as required by the employer of record.
7.8 Prior to teaching, faculty provided by the TUSD SCHOOL DISTRICT shall receive discipline-specific training and orientation from COLLEGE regarding, but not limited to, course curriculum, assessment criteria, pedagogy, course philosophy, testing and grading procedures record keeping, and other instructional responsibilities. Said training shall be approved by and provided by the COLLEGE.
7.77.9 Prior to teaching, faculty provided by the COLLEGE shall receive training and orientation from SCHOOL DISTRICT regarding, but not limited to, SCHOOL DISTRICT policies, practices and requirements. Said training shall be approved by and provided by the SCHOOL DISTRICT.
7.10 Faculty provided by the TUSD will SCHOOL DISTRICT are eligible to participate in professional development activities sponsored by the COLLEGE as required by the terms and condition of the contract and shall be encouraged to participate in ongoing collegial interaction to include, but not limited address course content, course delivery, assessment, evaluation, and/or research and development in the field. Adjunct faculty are not required to participate in these activities however, they are encouraged to participate.
7.8. Faculty performance 7.11 Performance of faculty members employed by the COLLEGE shall be evaluated by the COLLEGE using the adopted existing procedures as outlined in Article 14 – Evaluation of the Agreement between Monterey Peninsula Community College District (MPCCD) and Monterey Peninsula College Teachers Association (MPCTA). In cases where a faculty member is employed by the SCHOOL DISTRICT to teach AB288 courses, the performance expectations and evaluation process will be detailed in an Instructional Service Agreement between the COLLEGE and standards for faculty of SCHOOL DISTRICT. 7.9. 7.12 The COLLEGE may select instructors from TUSD SCHOOL DISTRICT personnel. TUSD SCHOOL DISTRICT personnel selected to be instructors may remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTRICT, but will also be subject to the direction authority of CLPCCD MPCCD specifically with regard to instruction and assessment provided their duties as instructors of record for the college course.
7.13 The COLLEGE coursesshall determine the number of instructors, the ratio of instructors to students, and the subject areas of instruction, subject to approval by MPCCD.

7.3 The COLLEGE shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty who are COLLEGE employees.
7.4 The COLLEGE shall be responsible for faculty salaries associated with the instructional class time of the classes conducted under this Agreement for faculty that are not SCHOOL DISTRICT employees. Any supplemental instruction related to the material presented in classes conducted under this Agreement by COLLEGE Employees, that extends beyond the college schedule, is the SCHOOL DISTRICT’s responsibility.
7.5 The CCAP Agreement Appendix shall specify which participating TUSD SCHOOL DISTRICT or COLLEGE will be the employer of record for sole and limited purposes of assignment monitoring and reporting to the county office of education.. Sec. 2 (m)(1)

Instructors. 7.1Instructors who teach DE Courses must be under the immediate supervision and control of an employee of PVCCD. All instructors teaching COLLEGE’s courses offered as part of this CCAP Agreement DE Courses must meet the minimum qualifications for instruction in a California community college as set forth in Sections Title 5 CCR sections 53410 and 58060 or as amended. The minimum qualifications for instruction in DE Courses shall be consistent with the requirements in other similar courses offered by PVCCD and shall be published or otherwise listed by PVCCD. 7.9PVCCD. COLLEGE may select instructors from TUSD SCHOOL DISTRICT personnel. TUSD SCHOOL DISTRICT personnel selected to be instructors remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTRICT, but will also be subject to the authority of PVCCD specifically with regard to their duties as instructors. SCHOOL DISTRICT may nominate SCHOOL DISTRICT instructors to teach DE Courses and shall ensure that all instructor nominees are experienced, competent, dedicated personnel who have the personal attributes necessary for providing instruction in the courses. SCHOOL DISTRICT shall ensure that all instructor/staff nominees possess any certificates or other training indicia that may be required including, but not limited to the minimum qualifications for teaching community college as set forth in Title 5 CCR 53410 and 58060 or as amended. COLLEGE shall determine the number of instructors, the ratio of instructors to students, and the subject areas of instruction, subject to approval by PVCCD. COLLEGE shall provide an orientation meeting for faculty and instructional resources such as manuals, course outlines, curriculum materials, and testing and grading procedures. All instructors who are SCHOOL DISTRICT employees must sign the Instructor Agreement, which states, among other things, that PVCCD shall have the primary right to control over the course content under the terms of this MOU. Instructors teaching courses under this MOU shall not have any other assigned duty while course instruction is taking place. The instructional services provided by SCHOOL DISTRICT personnel shall include development of appropriate lectures. The lectures will conform to the approved curriculum and course outlines and recommendations of experienced COLLEGE instructors and shall meet the academic standards and criteria of PVCCD. Instructional presentations shall incorporate planned practical demonstrations, as may be necessary, and use audio-visual techniques or equipment and vocational equipment. LIAISON AND COORDINATION OR RESPONSIBILITIES The COLLEGE shall appoint an educational administrator who will serve as liaison, and who will approve all dual enrollment instructors in consultation with the academic department of the COLLEGE and in conformity with PVCCD policies and standards. The liaison shall provide initial and ongoing training for dual enrollment faculty, conduct site visits, provide performance evaluations of instructors teaching DE Courses, and strengthen communication between essential elements of the SCHOOL DISTRICT, the COLLEGE, COLLEGE academic departments, and the COLLEGE student affairs office. The liaison will keep dual enrollment faculty informed of new curriculum developments, pedagogic innovations, textbook adoptions, educational outcomes, assessment of learning, grading standards, proficiency expectations, and syllabus components. The liaison will facilitate coordination and cooperation between COLLEGE and SCHOOL DISTRICT. COLLEGE will provide SCHOOL DISTRICT personnel with reasonable assistance, direction and instruction in how to fulfill their responsibilities under this MOU, including conducting appropriate student assessments, outreach/recruitment activities and compliance with PVCCD policy and the COLLEGE’S procedures and academic standards. SCHOOL DISTRICT shall provide personnel to perform clerical services and services assessing students, processing student applications, enrolling qualified students, and other related services as may be necessary. SCHOOL DISTRICT’s personnel will perform these services on duty time. DISTRICT personnel performing these services will be employees of SCHOOL DISTRICT, subject to the authority of SCHOOL DISTRICT, but will also be subject to the direction of CLPCCD COLLEGE, specifically with regard to instruction their duties pertaining to the DE Courses. 7.8. 7.11 Faculty performance shall be evaluated by the COLLEGE using the adopted evaluation process and standards for faculty of the COLLEGE, subject to the approval of CLPCCDSMC.
7.9. 7.12 Faculty provided by the SCHOOL DISTRICT who don’t comply with the policies, regulations, standards, and expectations of the COLLEGE shall be ineligible to teach dual enrollment courses.
7.13 The COLLEGE may select instructors from TUSD SCHOOL DISTRICT personnel. TUSD SCHOOL DISTRICT personnel selected to be instructors remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTRICT, but will also be subject to the direction authority of CLPCCD SMC specifically with regard to instruction and assessment provided their duties as instructors.

7.11 Instructors will meet with NUSD administrators to ensure required state minutes are met and adhere to NUSD Collective Bargaining Agreements.
7.12 Instructors provided by OCCD will not be liable for the COLLEGE high school students who are not enrolled in OCCD courses.

Prior to teachingInstructors will be provided course outlines of record, faculty provided by the TUSD shall receive discipline-specific training and orientation from COLLEGE regarding, but not limited to, course curriculum, assessment criteria, pedagogy, course philosophycurriculum materials, testing and grading procedures record keepingprocedures, and other instructional responsibilitiesinstructor orientations as provided to hourly on-campus instructors.
8.6. Said training Instructors must teach the college course in a manner consistent with the approved course outline of record from WKCCD. Students shall be approved by held to the same standards of achievement, grading standards, methods of assessment (e.g., papers, portfolios, quizzes, labs, etc.), and provided by behavioral standards (Exhibit "A" Student Code of Conduct), as those expected of students in courses taught on the COLLEGEWKCCD campus and at the TUHSD. Both parties will work together in resolving behavioral issues.
7.78.7. Faculty provided by The instructor shall determine the TUSD will participate in professional development activities sponsored by COLLEGE type, make, and model of all equipment, books and materials to be used during each course offered as required by the terms part of this Agreement and condition of the contract and shall submit for approval to WKCCD. TUHSD understands that no equipment or materials fee may be encouraged charged to participate in ongoing collegial interaction to include, but not limited address course content, course delivery, assessment, evaluation, and/or research and development in the fieldstudents per Education Code § 49011.
7.88.8. Faculty performance shall WKCCD instructors are not required to provide fundamental modifications to a course for students participating in this Agreement with Individual Education Plans or 504 plans. ▇▇▇▇▇ will communicate accommodations to instructors participating in this agreement.
8.9. Dual Enrollment instructors will be evaluated by COLLEGE using the adopted evaluation process WKCCD College faculty and standards for faculty of the COLLEGEadministration as outlined in ▇▇▇▇ College's collective bargaining agreement (Exhibit "B" Article 6.8.3, subject to the approval of CLPCCDTC Collective Bargaining Agreement).
7.98.10. COLLEGE may select instructors from TUSD personnel. Any supplemental instruction related to the material presented in classes conducted under this Agreement by COLLEGE Employees, that extends beyond the college schedule, is the SCHOOL DISTRICT’s responsibility.

TUSD SCHOOL DISTRI CT personnel selected to be instructors remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTR ICT, but will also be subject to the direction authority of CLPCCD RSCCD specifically with regard to instruction their duties as instructors.
7.10. The appropriate COLLEGE administrator, in consultation with the appropriate SCHOOL DISTRICT administrator, will grant final approval to SCHOOL DISTRICT teachers eligible to teach dual enrollment courses. RSCCD /SAC will orient the approved faculty member.
7.11. COLLEGE instructors will notify SCHOOL DISTRICT school counselors or higher education coordinators when a student enrolled in a college course provided under this CCAP agreement begins to struggle and assessment provided will refer the student for the COLLEGE coursesadditional support.

The COMMUNITY COLLEGE DISTRICT may select instructors from TUSD personnelSCHOOL DISTRICT personnel nominated by SCHOOL DISTRICT, or other sources. TUSD SCHOOL DISTRICT personnel will perform instructional duties on duty time. SCHOOL DISTRICT personnel selected to be instructors remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTRICT and the SCHOOL DISTRICT’s collective bargaining agreement, but will also be subject to the direction authority of CLPCCD COMMUNITY COLLEGE DISTRICT, specifically with regard to their duties as instructors. COMMUNITY COLLEGE DISTRICT will exercise this authority in consultation with SCHOOL DISTRICT. SCHOOL DISTRICT personnel selected to be instructors may be paid by the SCHOOL DISTRICT as part of their contract workload or by the COMMUNITY COLLEGE DISTRICT if the instruction is outside of their SCHOOL DISTRICT contract workload. When the instructor is paid by the COMMUNITY COLLEGE DISTRICT, the instructor will be paid at the rate established under the COMMUNITY COLLEGE DISTRICT part-time faculty bargaining agreement.

Consistent with the terms negotiated between NVCCD and the COLLEGE faculty association, instructors for courses offered as part of this CCAP Agreement shall be assigned as follows: • Courses will first be offered to regular faculty of NVCCD that meet the above- stated minimum qualifications and have participated. • If courses are not filled by regular faculty, they will be offered to NVCCD adjunct faculty who possess contractual rehire preference rights, and who meet the above-stated minimum qualifications. • If courses are still not filled, they may be offered to employees of SHUSD who meet the above-stated minimum qualifications. SHUSD personnel selected to be instructors remain employees of SHUSD, subject to the authority of SHUSD, but will also be subject to the authority of NVCCD specifically with regard to their duties as instructors.
8.3. COLLEGE shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty who are NVCCD employees. SHUSD shall be solely responsible for the salaries, wages, and benefits due to the dual enrollment faculty who are SHUSD employees, unless otherwise agreed by SHUSD and NVCCD.

7.8. 7.8 Faculty performance shall be evaluated by Las Positas COLLEGE using the adopted evaluation process and standards for faculty of the Las Positas COLLEGE, subject to the approval of CLPCCD, for the purposes of Las Positas COLLEGE employment.
7.9. 7.9 Las Positas COLLEGE may select instructors from TUSD TVROP personnel. TUSD TVROP personnel selected to be instructors remain employees of the TUSDTVROP, subject to the authority of the TUSDTVROP, but will also be subject to the direction authority of CLPCCD specifically with regard to instruction their duties as instructors.

7.10. The appropriate COLLEGE administrator, in consultation with the COLLEGE appropriate SCHOOL DISTRICT administrator, will grant final approval to SCHOOL DISTRICT teachers eligible to teach dual enrollment courses. RSCCD /SAC will orient the approved faculty member.

SCHOOL DISTRICT personnel selected to be instructors shall be paid by COMMUNITY COLLEGE DISTRICT at the rate established under the applicable collective bargaining agreement between SCHOOL DISTRICT and assessment provided for the bargaining unit of the SCHOOL DISTRICT. Instructors. 7.1. 7.1 All instructors teaching COLLEGE’s COLLEGE courses offered as part of this CCAP Agreement must meet the minimum qualifications for instruction in a California community college as set forth in Sections 53410 and 58060 of Title 5 of the California Code of Regulations, Sections 53410 and 58060 or as amended and be hired by the CLPCCDCOLLEGE and become SMC employees or be provided by the District and be District employees. Faculty provided by the SCHOOL DISTRICT, who are being paid by the SCHOOL DISTRICT, must also sign an Instructional Service Agreement (ISA)- Instructor and get approved by the COLLEGE Board.
7.27.2 The SCHOOL DISTRICT shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty teaching under an ISA who are SCHOOL DISTRICT employees.
7.3 The COLLEGE shall be solely responsible for all salaries, wages, and benefits due to dual enrollment faculty who are COLLEGE employees.
7.4 The COLLEGE shall be responsible for faculty salaries associated with the instructional class time of the classes conducted under this Agreement for faculty that are not SCHOOL DISTRICT employees. Any supplemental instruction related to the material presented in classes conducted under this Agreement by COLLEGE Employees, that extends beyond the college schedule, is the SCHOOL DISTRICT’s responsibility.
7.5 The CCAP Agreement Appendix shall specify which participating TUSD SCHOOL DISTRICT or COLLEGE will be the employer of record for sole and limited purposes of assignment monitoring and reporting to the county office of education.. Sec. 2 (m)(1)
7.3. 7.6 This CCAP Agreement specifies the TUSD SCHOOL DISTRICT will assume reporting responsibilities pursuant to applicable federal teacher quality mandates.. Sec. 2 (m)(2)
7.47.7 The COLLEGE shall have the primary right to control and direct the activities of faculty teaching dual enrollment courses. Instructors who teach COLLEGE’s COLLEGE courses offered as part of this CCAP Agreement must provide the supervision and control reasonably necessary for the protection of the health and safety of students and may not have any other assigned duty during the instructional activity. As a general rule, faculty must be physically present in the classroom or lab or within line-of-sight of the students.
7.5. 7.8 Instructors who teach COLLEGE’s COLLEGE courses at TUSD shall comply with the fingerprinting requirements set forth in Education Ed Code section 45125.1, § 45125 or as amended and the tuberculosis testing and risk assessment requirements of California Health and Safety Code section 49406§ 121525 or as amended. In addition to any other prohibition or provision, no person who has been convicted of a violent or serious felony shall be eligible to teach any courses offered as part of this CCAP Agreement or otherwise provide services on a TUSD SCHOOL DISTRICT site.
7.6. 7.9 Prior to teaching, faculty provided by the TUSD SCHOOL DISTRICT shall receive discipline-specific training and orientation from COLLEGE regarding, but not limited to, course curriculum, assessment criteria, pedagogy, course philosophy, testing and grading procedures record keeping, and other instructional responsibilities. Said Faculty training shall be approved by and provided by the COLLEGE.
7.7. 7.10 Faculty provided by the TUSD SCHOOL DISTRICT will participate in professional development activities sponsored by the COLLEGE as required by the terms and condition of the contract and shall be encouraged to participate in ongoing collegial interaction to include, but not limited address course content, course delivery, assessment, evaluation, and/or research and development in the field.
7.8. 7.11 Faculty performance shall be evaluated by the COLLEGE using the adopted evaluation process and standards for faculty of the COLLEGE, subject to the approval of CLPCCDSMC.
7.12 Faculty provided by the SCHOOL DISTRICT who don’t comply with the policies, regulations, standards, and expectations of the COLLEGE shall be ineligible to teach dual enrollment courses.
7.9. 7.13 The COLLEGE may select instructors from TUSD SCHOOL DISTRICT personnel. TUSD SCHOOL DISTRICT personnel selected to be instructors remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTRICT, but will also be subject to the direction authority of CLPCCD SMC specifically with regard to instruction and assessment provided their duties as instructors.

Upon receipt of a complaint alleging harassment, discrimination or any other violation of law, including but not limited to Title IX, the designated employee from the entity receiving the complaint shall inform and provide a copy of such complaint to the designated employee from the other entity. The designated employees from the COLLEGE and SCHOOL DISTRICT shall review the facts giving rise to the complaint and determine which entity will take the lead on investigating, managing and resolving such complaint. Neither COLLEGE nor SCHOOL DISTRICT may abandon or assign their obligations under the law, including Title IX.
7.4. 7.5 Instructors who teach COLLEGE’s COLLEGE courses offered as part of this CCAP Agreement must provide the supervision and control reasonably necessary for the protection of the health and safety of students and may not have any other assigned duty during the instructional activity.
7.5. 7.6 Instructors who teach COLLEGE’s COLLEGE courses at TUSD shall comply with the fingerprinting requirements set forth in Ed Code § 45125 and/or Education Code section 45125.1, Section 87013 as amended and the tuberculosis testing and risk assessment requirements of California Health and Safety Code section 49406§ 121525 and/or Education Code Section 87408.6 as amended. In addition to any other prohibition or provision, no person who has known to have been convicted of a violent or serious felony shall be eligible to teach any courses offered as part of this CCAP Agreement or otherwise provide services on a TUSD SCHOOL DISTRICT site. Instructors shall be employed in accordance with Education Code Sections 87405 et seq. when the COLLEGE is designated the employer of record.
7.6. 7.7 Faculty will complete mandatory training as required by the employer of record.

7.77.9 Prior to teaching, faculty provided by the COLLEGE shall receive training and orientation from SCHOOL DISTRICT regarding, but not limited to, SCHOOL DISTRICT policies, practices and requirements. Said training shall be approved by and provided by the SCHOOL DISTRICT.
7.10 Faculty provided by the TUSD will SCHOOL DISTRICT are eligible to participate in professional development activities sponsored by the COLLEGE as required by the terms and condition of the contract and shall be encouraged to participate in ongoing collegial interaction to include, but not limited address course content, course delivery, assessment, evaluation, and/or research and development in the field. Adjunct faculty are not required to participate in these activities however, they are encouraged to participate.
7.8. Faculty performance 7.11 Performance of faculty members employed by the COLLEGE shall be evaluated by the COLLEGE using the adopted existing procedures as outlined in Article 14 – Evaluation of the Agreement between Monterey Peninsula Community College District (MPCCD) and Monterey Peninsula College Teachers Association (MPCTA). In cases where a faculty member is employed by the SCHOOL DISTRICT to teach AB288 courses, the performance expectations and evaluation process will be detailed in an Instructional Service Agreement between the COLLEGE and standards for faculty of SCHOOL DISTRICT. 7.57.5 COLLEGE and SCHOOL DISTRICT certify that any remedial course taught by community college faculty at a partnering high school campus shall be offered only to high school students who do not meet their grade level standard in math, English, or both on an interim assessment in grade 10 or 11, as determined by the partnering school district, and shall involve a collaborative effort between high school and community college faculty to deliver an innovative remediation course as an intervention in student’s junior or senior year to ensure the student is prepared for college-level work upon graduation. 7.4 The COLLEGE shall be responsible for faculty salaries associated with the instructional class time of the classes conducted under this Agreement for faculty that are not SCHOOL DISTRICT employees. Any supplemental instruction related to the material presented in classes conducted under this Agreement by COLLEGE Employees, that extends beyond the college schedule, is the SCHOOL DISTRICT’s responsibility.
7.5 The CCAP Agreement Appendix shall specify which participating TUSD SCHOOL DISTRICT or COLLEGE will be the employer of record for sole and limited purposes of assignment monitoring and reporting to the county office of education.. Sec. 2 (m)(1)
7.3. 7.6 This CCAP Agreement specifies the TUSD SCHOOL DISTRICT will assume reporting responsibilities pursuant to applicable federal teacher quality mandates.. Sec. 2 (m)(2)
7.47.7 The COLLEGE shall have the primary right to control and direct the activities of faculty teaching dual enrollment courses. Instructors who teach COLLEGE’s COLLEGE courses offered as part of this CCAP Agreement must provide the supervision and control reasonably necessary for the protection of the health and safety of students and may not have any other assigned duty during the instructional activity. As a general rule, faculty must be physically present in the classroom or lab or within line-of-sight of the students.
7.5. 7.8 Instructors who teach COLLEGE’s COLLEGE courses at TUSD shall comply with the fingerprinting requirements set forth in Education Ed Code section 45125.1, § 45125 or as amended and the tuberculosis testing and risk assessment requirements of California Health and Safety Code section 49406§ 121525 or as amended. In addition to any other prohibition or provision, no person who has been convicted of a violent or serious felony shall be eligible to teach any courses offered as part of this CCAP Agreement or otherwise provide services on a TUSD SCHOOL DISTRICT site.
7.6. 7.9 Prior to teaching, faculty provided by the TUSD SCHOOL DISTRICT shall receive discipline-specific training and orientation from COLLEGE regarding, but not limited to, course curriculum, assessment criteria, pedagogy, course philosophy, testing and grading procedures record keeping, and other instructional responsibilities. Said Faculty training shall be approved by and provided by the COLLEGE.
7.7. 7.10 Faculty provided by the TUSD SCHOOL DISTRICT will participate in professional development activities sponsored by the COLLEGE as required by the terms and condition of the contract and shall be encouraged to participate in ongoing collegial interaction to include, but not limited address course content, course delivery, assessment, evaluation, and/or research and development in the field.
7.8. 7.11 Faculty performance shall be evaluated by the COLLEGE using the adopted evaluation process and standards for faculty of the COLLEGE, subject to the approval of CLPCCDSMC.
7.9. 7.12 Faculty provided by the SCHOOL DISTRICT who don’t comply with the policies, regulations, standards, and expectations of the COLLEGE shall be ineligible to teach dual enrollment courses.
7.13 The COLLEGE may select instructors from TUSD SCHOOL DISTRICT personnel. TUSD SCHOOL DISTRICT personnel selected to be instructors remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTRICT, but will also be subject to the direction authority of CLPCCD SMC specifically with regard to instruction and assessment provided their duties as instructors.
7.14 The COLLEGE will be the employer of record for all community college-paid faculty teaching at the COLLEGE coursesSCHOOL DISTRICT.

TUSD personnel selected to be instructors remain employees students, and the subject areas of the TUSDinstruction, subject to the authority of the TUSD, but will also be subject to the direction of CLPCCD specifically with regard to instruction and assessment provided for the COLLEGE coursesapproval by 4CD.

7.8. Faculty performance shall be evaluated by the COLLEGE for the college courses using the adopted evaluation of process and standards for faculty of the COLLEGE, subject to the approval of CLPCCDRSCCD.
7.9. The COLLEGE may and SCHOOL DISTRICT will work jointly to recruit and select instructors from TUSD SCHOOL DISTRICT personnel. TUSD SCHOOL DISTRI CT personnel selected to be instructors remain employees of the TUSDSCHOOL DISTRICT, subject to the authority of the TUSDSCHOOL DISTR ICT, but will also be subject to the direction authority of CLPCCD RSCCD specifically with regard to instruction their duties as instructors.
7.10. The appropriate COLLEGE administrator, in consultation with the appropriate SCHOOL DISTRICT administrator, will grant final approval to SCHOOL DISTRICT teachers eligible to teach dual enrollment courses. RSCCD /SAC will orient the approved faculty member.
7.11. COLLEGE instructors will notify SCHOOL DISTRICT school counselors or higher education coordinators when a student enrolled in a college course provided under this CCAP agreement begins to struggle and assessment provided will refer the student for the COLLEGE coursesadditional support.

Instructors. 7.1. 6.1 All instructors teaching COLLEGE’s COMMUNITY COLLEGE DISTRICT courses offered as part of under this CCAP Agreement must meet the minimum qualifications for instruction in a California community college college, as set forth in Sections 53410 and 58060 of Title 5 of the California Code of Regulations, and required by applicable law. Such instructors may be hired by the CLPCCDCOMMUNITY COLLEGE DISTRICT and become COMMUNITY COLLEGE DISTRICT employees or may be OFFICE OF EDUCATION employees provided by the OFFICE OF EDUCATION. Instructors who are employees of the OFFICE OF EDUCATION, and not of the COMMUNITY COLLEGE DISTRICT, shall enter into an Adjunct Faculty Agreement with the COMMUNITY COLLEGE DISTRICT
6.2 The OFFICE OF EDUCATION shall be solely responsible for all salaries, wages, and benefits due to instructors of courses offered under this Agreement who are OFFICE OF EDUCATION employees.
7.26.3 The COMMUNITY COLLEGE DISTRICT shall be solely responsible for all salaries, wages, and benefits due to instructors of courses offered under this Agreement who are COMMUNITY COLLEGE DISTRICT employees.
6.4 The COMMUNITY COLLEGE DISTRICT shall be responsible for instructor salaries associated with the instructional class time of the classes conducted under this Agreement, provided the instructor is not an employee of the OFFICE OF EDUCATION. The CCAP Agreement Appendix shall specify which participating TUSD or COMMUNITY COLLEGE will be DISTRICT has no obligation to compensate instructors for any supplemental instruction, including supplemental instruction related to course material that extends beyond the employer of record for sole and limited college schedule.
6.5 For purposes of assignment monitoring and reporting to the county office California Department of educationEducation, the OFFICE OF EDUCATION will be the employer of record with respect to courses for which the instructor is an employee of the OFFICE OF EDUCATION; for other courses offered under this Agreement, COMMUNITY COLLEGE DISTRICT will be the employer of record.
