Insufficient Work Clause Samples

The Insufficient Work clause defines the procedures and rights of the parties when there is not enough work available to keep employees or contractors fully engaged. Typically, this clause outlines the employer's ability to reduce hours, temporarily lay off staff, or reassign duties if business needs decrease unexpectedly. For example, it may specify notice requirements or compensation adjustments during periods of low workload. Its core function is to provide a clear framework for managing workforce levels during downturns, thereby protecting both the employer from unnecessary costs and the employee from uncertainty.
Insufficient Work. (a) Where there is insufficient work within a classification and department on any day, the Employer may release employees in the classification and department in order of reverse seniority and pay those employees for actual time worked with a minimum of three (3) hours for part-time employees in the Banquet Department and a minimum of four (4) hours for all employees covered by this Agreement, unless he / she requests to leave early on his / her own accord. (b) Employees are to advise the Department Manager or designate at the start of their shift that they wish to be released from their shift early. In cases where more than one employee is requesting to leave early and management decides to allow employee(s) to leave early, shift starting time shall be the governing factors for first off amongst those who have indicated their wish. Where shift starting time is the same for two (2) or more employees then seniority shall be the governing factor. Where there are no volunteers, the Employer will release the employees in reverse order of seniority.
Insufficient Work. Where there is insufficient work within a classification and department on any day, the Employer may release employees in the classification and department in order of reverse seniority and pay those employees for actual time worked with a minimum of three (3) hours for all employees covered by this Agreement, unless he / she requests to leave early on his / her own accord.
Insufficient Work. (1) If an employee reports to work as scheduled and is advised by the Employer that there is insufficient or no work available he is entitled to four (4) hours pay at the straight time rate. (2) If an employee is directed to report for work on a day of rest or on Designated Paid Holiday, and there is insufficient work available, he shall be entitled to four (4) hours of work at the appropriate overtime rate. When no work is available he shall receive compensation to four (4) hours pay at the appropriate overtime rate.

  • Insufficient Funds If at any time insufficient funds are received by and available to the Administrative Agent to pay fully all amounts of principal, L/C Borrowings, interest and fees then due hereunder, such funds shall be applied (i) first, toward payment of interest and fees then due hereunder, ratably among the parties entitled thereto in accordance with the amounts of interest and fees then due to such parties, and (ii) second, toward payment of principal and L/C Borrowings then due hereunder, ratably among the parties entitled thereto in accordance with the amounts of principal and L/C Borrowings then due to such parties.

  • Late or Insufficient Payment All invoiced balances under this Agreement that are not paid in full by the due date will be subject to the DSP or Illinois Commerce Commission late payment rules.

  • Sufficient Funds With respect to the Additional Loans, the amount on deposit in the Supplemental Purchase Account shall be greater than or equal to the related Additional Loans Purchase Price.
