Common use of Internal Applicants Clause in Contracts

Internal Applicants. a. Internal employment notices for Permanent, Student and Temporary positions shall be kept up to date and on file with the Employer and the Union. Upon receiving notice that a position will become vacant, the Staff Liaison Officer shall immediately post the internal employment notice. b. Existing employees may transfer to a vacant position in the same classification upon receipt of a majority recommendation of the Hiring Committee. The Hiring Committee shall not approve an application for transfer of an employee who has already transferred once in the previous 12 months. The Hiring Committee may waive this requirement to address a particular workplace circumstance. c. These positions shall be advertised internally and any employee may transfer to a vacant position within the same classification provided that they possess the skills, knowledge and ability to perform the necessary job functions as determined by the Hiring Committee, based on the job description. In the event that the Hiring Committee receives two (2) or more applications from employees that meet the requirements, then the employee with the greatest seniority shall be the successful applicant. d. When transferred or recalled to a new position, an employee will be placed on a Trial Period for up to ninety (90) calendar days. If the employee finds the position unsatisfactory or as determined by the Hiring Committee for the position, is unable to meet the requirements of the position, they will return to their former position or be placed on the recall list if their previous position has been discontinued. If, because of this situation, another employee was recalled to fill the employee's previous position, then they will be returned to the recall list. e. An employee who wishes to transfer or recall to a vacant position within the same classification shall indicate so, in writing, to the Hiring Committee within five (5) working days of the first advertisement. The employee shall have an additional five (5) working days to submit their formal written application. f. If no application to transfer or recall is received, or if no suitable internal applicant is found for any vacant position, as determined by the Hiring Committee, the position shall be advertised externally. Upon mutual agreement, advertisements for vacant positions may be simultaneously posted internally and externally. In such cases the Hiring Committee will give first consideration to all internal applicants.

When transferred or recalled Successful internal job applicants shall be deemed to be in a probationary status for a period not to exceed three (3) months, and shall be so notified at the time of commencing their new position, an employee will be placed on a Trial Period for up to ninety (90) calendar daysemployment. If within the three (3)- month period INDG determines that the employee finds is not able to perform the position unsatisfactory or as determined by required job duties, the Hiring Committee for the position, is unable employee shall be returned without prejudice to meet the requirements of the position, they will return to their former position or be placed on the recall list if their previous position has been discontinued. If, because of this situation, another employee was recalled to fill the employee's previous position’s former job, then they will be returned to if available, or a comparable job in the recall listsame classification. e. An employee who wishes to transfer or recall to a vacant position within the same classification shall indicate so, in writing, When an opening has been filled pursuant to the Hiring Committee within five (5) working days foregoing provisions, INDG shall advise the Unit Chairperson of the first advertisement. The employee shall have an additional five (5) working days to submit their formal written applicationname, salary, and classification of the person selected. f. If no application to transfer INDG may consider filling junior level or recall is received, or if no suitable internal applicant is found trainee positions during the term of this agreement. Such positions will normally be one grade lower than that of the usual entry grade level position. INDG will determine the minimum qualifications for any vacant position, as determined by the Hiring Committee, the position these positions. The trainee shall be advertised externallypromoted when INDG determines, in its discretion, that the trainee satisfies the stated criteria for the next higher grade level position. Upon mutual agreementINDG will notify the Guild of the names of new junior level and trainee hires in accordance with Article VII, advertisements for vacant positions may be simultaneously posted internally and externally. In such cases the Hiring Committee will give first consideration to all internal applicantsSection 1.
