Common use of Internal process Clause in Contracts

Internal process. (a) If any party to the dispute or grievance who is bound by the agreement refers the dispute or grievance to an established internal dispute or grievance resolution process, the matter must first be dealt with in accordance with that process. (b) If the dispute or grievance is not settled through an internal dispute or grievance resolution process, the matter can be dealt with in accordance with the processes set out below. (c) If the matter is not settled, the Employer, Employee or the Employee’s chosen representative (which may include an officer or employee of the Union) may apply to the Commission to have the dispute or grievance dealt with by conciliation.
