Common use of JOINT AND INDIVIDUAL INTERESTS Clause in Contracts

JOINT AND INDIVIDUAL INTERESTS. If there is more than one named insured on this policy, any named insured may cancel or change this policy. The action of one named insured shall be binding on all persons provided coverage under this policy. If you have asked us to exclude any person from coverage under this policy, it is agreed that the insurance afforded by this policy shall not apply with respect to any claim or loss which occurs due to the ownership, operation, maintenance or use of any vehicle(s), either with or without the express or implied permission of the named insured, while being operated by the excluded person. You further agree that the Company shall not be liable and no liability or obligation of any kind shall attach to the Company for any negligence or liability, vicarious or otherwise, which may be imputed by law to you or any other person, arising out of the maintenance, operation or use of a motor vehicle by the excluded person. Nothing contained in this provision shall vary, waive, alter or extend any other terms or conditions of the policy. This provision shall supersede any policy provisions to the contrary and shall take effect simultaneously with such policy.
