Common use of Joint Stipulation Clause in Contracts

Joint Stipulation. (a) The Company and the Union, on behalf of the employee concerned, shall within ten (10) calendar days prior to the date of the hearing as fixed by the arbitrator sign a joint stipulation of the dispute or question which is to be arbitrated. Such stipulation shall contain a statement of the issue in dispute and in addition may include a brief statement of the position of the Company as well as a brief statement of the position of the Union on the question at issue. (b) The Company agrees that it will not dispute the arbitrability of any grievance based upon the failure of the parties to submit a joint submission.
