Common use of Layoff and Bumping Clause in Contracts

Layoff and Bumping. In the event of layoff, a layoff shall occur in reverse order of seniority by position. Position shall be defined as the position /title as set out in Appendix "A" of the Collective Agreement. The least senior employee in the affected position shall be the first laid off. Employees subject to a layoff have the right to accept the layoff. In the event of a recall the most senior person remaining on layoff shall be the first recalled; provided they possess the necessary skills, qualifications, and abilities to perform the work available, including all vacant positions. Where both parties agree a training period may be considered.
