Common use of Leave of Absence for Full-Time Union or Public Duties Clause in Contracts

Leave of Absence for Full-Time Union or Public Duties. (a) Upon written request, the Employer shall grant leave of absence without pay for periods of less than 90 calendar days so that the employee may be a candidate in federal, provincial or municipal elections provided the leave does not commence more than 7 calendar days prior to the final date for the filing of nomination and the leave does not extend more than 7 calendar days after the official counting of ballots. During the leave of absence, benefits shall be maintained on the same basis as if the employee were not on leave of absence. (b) Upon written request, the Employer shall grant leave of absence without pay to an employee who is elected to a full-time office with the Union or any body with which the Union is affiliated. Such leave shall be granted for the term of office. (c) Upon written request, the Employer shall grant leave of absence without pay to an employee who is selected for a full-time position with the Union or any body with which the Union is affiliated. Such leave of absence shall be granted for a period not exceeding two years.
