LICENSE CONDITIONS AND RESTRICTIONS. The license granted to you consists of the following conditions, and violation of these conditions will be deemed as infringement upon the intellectual property rights of Pearl Abyss and the Game Software. Upon entering this Agreement, you will be granted the rights to use the game software or its parts only as specified within this Agreement. As such, you SHALL NOT under any circumstances: • make copies of the Game Software or any part thereof, except that you may make one (1) copy of the Game Software for backup or archival purposes, or make copies of the materials accompanying the Game Software for non-commercial backup and reference only; • use any third party programs that are not authorized by Pearl Abyss, including programs, devices or mechanisms of any kind that make use of hacks, cheats, scripts, bots, trainers, automation program that interact with the Game Software in any way, for any purpose, including any unauthorized third party programs that intercept, emulate, or redirect any communication between the Game Software and Pearl Abyss and any unauthorized third party programs that collect information about the Game by accessing the parts of the Game Software that stores information; • use, advertise, or exploit in any manner the Game Software or any of its parts commercially, including but not limited to use at a cyber (Internet) café, computer gaming center or any other location-based site, without written permission from Pearl Abyss; o This includes collecting in-game currency, items or resources for the purposes of selling them, as well as illegal services such as transacting out-of-game funds to raise game characters by proxy or any other illegal services listed in the 'Operational Policy' • obtain information about other users or the Company through the game or service(unless this is so provided for in the game), data mining, and using unauthorized third-party software; • modify certain files within the Game Software or disclose the reason for modification to others in ways that are not explicitly approved by Pearl Abyss; • obtain, copy, resend communication protocols sent by Pearl Abyss, using the Game Software inappropriately to provide or develop unauthorized game services, regardless of intention; o This includes unauthorized online network plays and/or setting up content collection networks. • imitate, copy the Game Software, log into a server that is the result of unauthorized imitation / copy of the Game Software, promoting/distribu...

Customer assumes sole responsibility for use of any such credentials and shall notify ▇▇▇▇▇▇▇.▇▇ immediately if such credentials are, or are suspected to have been, misappropriated. Customer must follow the recommended installation procedures for Software licensed under the MSA. Unless otherwise agreed upon, Customer agrees that the server(s) on which the Software will be installed will be connected at all times to the Internet and not to block, electronically or otherwise, the transmission of data required for compliance with the MSA. Any blocking of data required for compliance under the MSA is a material breach of the MSA. Customer is responsible for providing the systems, servers, software and network and communications necessary to access and use the Software. Customer is responsible for all acts and omissions of its Users as if they were Customer’s acts and omissions.

  • License and Restrictions (a) Subject to the terms of this Agreement, we hereby grant you a limited, personal, revocable, nonexclusive, non sublicensable, non assignable, non transferable, non resellable license and right to use the Service. You agree not to intercept, capture, emulate, or redirect the communications protocols used by us for any purpose, including without limitation causing the Service to connect to any computer server or other device not authorized by us. (e) We reserve the right to add or delete features or functions, or to provide programming fixes, updates and upgrades, to the Service. You acknowledge and agree that we have no obligation to make available to you any subsequent versions of the Service. You also agree that you may have to enter into a renewed version of this Agreement if you want to download, install or use a new version of the Service. (f) We have no obligation whatsoever to furnish any maintenance and support services with respect to the Service, and any such maintenance and support services provided will be provided at our discretion. (g) You grant to us a nonexclusive, perpetual, non-revocable, royalty free license to use, retain, and share any information transmitted through the Service by you, including, your location, device-based location information, account numbers, name, date, account amount, and endorsements solely for the purpose of providing the Services. This license shall survive termination of this Agreement for such period as necessary for us to provide the Services, comply with the law, or comply with an internal guidelines or procedures.

  • Limitations and Restrictions Deduction of Rollovers and Transfers – A deduction is not allowed for rollover or transfer contributions.

  • Covenants, Conditions and Restrictions This Lease is subject to the effect of (i) any covenants, conditions, restrictions, easements, mortgages or deeds of trust, ground leases, rights of way of record and any other matters or documents of record; and (ii) any zoning laws of the city, county and state where the Building is situated (collectively referred to herein as "Restrictions") and Tenant will conform to and will not violate the terms of any such Restrictions.

  • Prohibitions and Restrictions The provisions of this Agreement shall not in any way limit the right of either Contracting Party to apply prohibitions or restrictions of any kind or take any other action which is directed to the protection of its essential security interests, or to the protection of public health or the prevention of diseases and pests in animals or plants.

  • License Grant and Restrictions You are granted a personal, limited, non-exclusive, non-transferable license, to electronically access and use the Money Management Service (the "Service") solely to manage your financial data, and the purchase rewards application ("Debit Rewards Offers") to benefit from your debit card purchases. You are not licensed or permitted to do any of the following and you may not allow any third party to do any of the following: (i) access or attempt to access any other systems, programs or data that are not made available for public use; (ii) copy, reproduce, republish, upload, post, transmit, resell or distribute in any way the material from the Money Management site or from the Debit Rewards Offers program; (iii) permit any third party to benefit from the use or functionality of the Service or Debit Rewards Offers, or any other services provided in connection with them, via a rental, lease, timesharing, service bureau, or other arrangement; (iv) transfer any of the rights granted to you under this license; (v) work around any technical limitations in the Service, use any tool to enable features or functionalities that are otherwise disabled in the Service, or decompile, disassemble, or otherwise reverse engineer the Service except as otherwise permitted by applicable law; (vi) perform or attempt to perform any actions that would interfere with the proper working of the Service or Debit Rewards Offers or any services provided in connection with them, prevent access to or the use of the Service, Debit Rewards Offers or any or services provided in connection with them by other licensees or customers, or impose an unreasonable or disproportionately large load on the infrastructure while using the Service; or
