Common use of Limitation on the Parties Clause in Contracts

Limitation on the Parties. Neither Party shall make any use of the other Party’s name, logo, likeness in any publication, promotional material, news release, or similar issuance or material without the other Party’s prior review, approval, and written consent. ▇▇▇▇▇▇ agrees and acknowledges that any reference or likeness to “Duke” shall be a prohibited use of Buyer’s name, logo, likeness. ▇▇▇▇▇▇ agrees and acknowledges that any direct or indirect implication of any endorsement, partnership, support, or testimonial of Seller by ▇▇▇▇▇ is prohibited, and any such use, endorsement, partnership, support, and/or testimonial will be an Event of Default under this Agreement. Subject to the foregoing, either Party may disclose to the public general information in connection with the Party’s respective business activities; provided, however, no such disclosure or publicity by Seller will directly or indirectly imply any endorsement, partnership, support, or testimonial of Seller by ▇▇▇▇▇.
