LIMITED SCOPE OF AGREEMENT. 2.1 This Agreement and the Authorized EULAs apply only to the use and licensing of Software by Licensee. All terms in an Authorized EULA regarding services (other than warranty services) are void.
2.2 Neither this Agreement nor an Authorized EULA authorize any Licensee to pay any funds directly to Licensor. All terms in a EULA regarding pricing, payment, interest, and delivery are void. This Agreement and the Authorized EULAs are independent of, and do not form a part of a Procurement Contract. Ordering and Confirming Documents may not be issued pursuant to an Authorized ▇▇▇▇, but must be issued pursuant to a Procurement Contract. Ordering and Confirming Documents form a part of this Agreement and the Authorized EULAs but only to the extent they memorialize the number of, configuration of, and prices paid for licenses ordered and provided. Ordering and Confirming Documents may not supplement, alter, or modify any provision of this Agreement or an Authorized EULA.
2.3 Subject to the limits of item 2.1, this Agreement and the Authorized EULAs apply to all licenses of Software licensed from Licensor by a Licensee during the term of this Agreement, whether acquired directly from Licensor or indirectly through a Distributor.
LIMITED SCOPE OF AGREEMENT. All obligations of the Borrowers under the Credit Agreement and the other Loan Documents (including, without limitation, the Obligations) remain in full force and effect except as expressly set forth herein.
LIMITED SCOPE OF AGREEMENT. Except as otherwise expressly set forth herein, all obligations of Borrower under the Agreement shall remain in full force and effect as written and shall be enforceable in accordance with their respective terms, subject to applicable bankruptcy, insolvency, fraudulent conveyance, reorganization, moratorium and similar laws affecting creditors' rights and remedies generally. Borrower acknowledges and agrees that, except as specifically set forth in SECTION 2.2, Lender has not waived any defaults or agreed to forbear from exercising or enforcing any rights or remedies it may have as a result of any other failure by Borrower to comply fully with the Agreement or the terms of this Amendment.

Nothing contained in this Forbearance Agreement shall be interpreted as or be deemed a release or a waiver by Bank of any of the terms and conditions of the Loan Documents, or any other documents, instruments and agreements between the parties hereto except as specifically provided in this Forbearance Agreement. Unless specifically modified herein, all other terms and provisions of the Loan Documents shall remain in full force and effect in accordance with their original terms, and are hereby ratified and confirmed in all respects. This Forbearance Agreement does not constitute a waiver or release by Bank of any obligations between Borrower and Bank, or a waiver by Bank of any defaults by Borrower under the Loan Documents, unless expressly so provided herein, nor between Bank and any other person or entity. The Bank has no duty to advance any funds under the Loan Documents.

(a) Nothing contained in this Agreement shall be interpreted as or be deemed a release or a waiver by Bank of any of the terms and conditions of the Loan Documents, or any other documents, instruments and agreements between the parties hereto except as specifically provided in this Agreement. Unless specifically modified herein, all other terms and provisions of the Loan Documents shall remain in full force and effect in accordance with their original terms, and are hereby ratified and confirmed in all respects. This Agreement does not constitute a waiver or release by Bank of any obligations between Borrower and Bank unless expressly so provided herein, nor between Bank and any other person or entity.
(b) Each reference in the Loan Agreement to "this Agreement," "the Agreement," "herein," "hereof," or words of similar meaning referring to the Loan Agreement, and each reference in any other document or agreement entered into in connection with the Loan Agreement to "the Loan Agreement," "thereof," "therein," or words of similar meaning referring to the Loan Agreement, shall mean and be a reference to the Loan Agreement as amended hereby.
LIMITED SCOPE OF AGREEMENT. This Agreement interprets and clarifies disputes regarding certain provisions of the Development Agreement and their application and operation under changes in statutory law, or changed circumstances beyond the control of the Parties, such as the COVID-19 pandemic. Except as otherwise set forth in this AGREEMENT, all provisions of the Development Agreement shall remain unchanged, including all deadlines set forth therein unless otherwise extended by law.
LIMITED SCOPE OF AGREEMENT. The purpose of this Agreement is to permit the renovation and reactivation of the Landfill Tap and the use of SOUTH ARAPAHOE facilities and the Interceptor to convey leachate from the Landfill to the Plant as recited herein. This Agreement shall not be construed or asserted as the basis of any offer or willingness or ability on the part of SOUTH ARAPAHOE, SOUTHGATE, or ENGLEWOOD to provide sanitary sewer service to the public generally or to any area outside the specific limits of the Landfill, except as is specifically provided herein.
LIMITED SCOPE OF AGREEMENT. Nothing in this Agreement shall impose upon SL Industries or any of its subsidiaries or affiliates any obligation to retain the services of Day as an employee or officer, or impose upon Day any obligation to continue as an employee or officer of any of them.
LIMITED SCOPE OF AGREEMENT. Nothing contained in this Agreement shall be interpreted as or be deemed a release or a waiver by any Purchaser of any of the terms or conditions of such Purchaser’s Purchase Documents, or any other documents, instruments and agreements between the parties hereto except as specifically provided in this Agreement. Unless specifically modified herein, all other terms and provisions of the Purchase Documents shall remain in full force and effect in accordance with their original terms. This Agreement does not constitute a waiver or release by any Purchaser of any obligations between any Peregrine Party and any Purchaser, or a waiver by any Purchaser of any defaults by any Peregrine Party under the Purchase Documents, unless expressly so provided herein, nor between any Purchaser and any other Person.
LIMITED SCOPE OF AGREEMENT. Nothing in this Agreement is intended to or will be applied in such a way as to interfere with those rights under federal, state or local employment discrimination laws which cannot be released. These rights include but are not limited to Employee’s right to file or otherwise pursue a charge that one or more of these laws has been violated, Employee’s right to participate in a proceeding with any appropriate federal, state or local government agency enforcing these laws, and Employee’s right to cooperate with any such agency in its investigation of a charge, none of which will constitute a breach of this Agreement.
