Local Measures. In addition to the mitigation measures required and enforced through the Corps’ Section 404 permit and state approval processes for NISP, Northern Water and/or the NISP Enterprise will implement the Local Measures described in this IGA as additional protections for Larimer County residents and natural resources. This recognizes that the Parties have a joint interest in the well-being of the County’s residents and natural resources during Project construction and operation. These specific Local Measures have been agreed to by the Parties to address the purpose and intent of Section 14 of the Larimer County Land Use Code. They are in addition to and separate from the conditions and measures in other permits and approvals, and are enforceable only by the Parties through this IGA. This includes measures relating to the physical security of Our facilities used to deliver them, measures to control access rights to Our assets and relevant networks, and processes for testing these measures. In accordance with Our obligations under applicable law, We may undertake digital forensic investigations in relation to the use of the Services and Subscriptions. You are responsible for using, and ensuring that your Users use, the controls and advice provided by the Services correctly and consistently.
