Loss of Customer Data. In the event of any loss or damage to Customer Data, Quinyx will use reasonable commercial efforts to restore the lost or damaged Customer Data from the latest back-up of such Customer Data that is maintained by Quinyx in accordance with the Information Security Overview. Quinyx shall not be responsible for any loss, destruction, unavailability, alteration or disclosure of Customer Data caused by any third party provided that Quinyx can show that Quinyx has materially complied with the obligations set forth in the Information Security Overview.
