Common use of Management and Direction Clause in Contracts

Management and Direction. The management and the operation of, and the direction and promotion of the working forces is vested exclusively in the Management of the Employer provided, however, that this will not be used for purposes of discrimination against employees. The Union recognizes that, subject to the limitations set out in this Agreement, the functions of the Employer include the following: a) maintain order, discipline, and efficiency; b) select, hire, assign, direct, promote, demote, classify, transfer, lay off, recall, suspend or otherwise discipline or discharge employees (for proper cause); c) determine the work to be done, including the location, methods, work assignments, and the schedule for the performance of such work; d) make, enforce, and alter from time to time, reasonable rules and regulations to be observed by the employees.
