Common use of MANAGEMENT PREROGATIVE Clause in Contracts

MANAGEMENT PREROGATIVE. The management and direction of the Hospital and the 4 employees, including but not limited to the right to hire, layoff, promote, demote, 5 transfer, discharge, or discipline for cause, to subcontract work, to make and 6 enforce work rules, regulations and personnel polices and procedures, to require reasonable overtime, to maintain discipline of the employees and efficiency of the Hospital, to determine job duties, job assignments and working schedules, and to 8 determine the services to be provided, the kind and location of facilities, the 9 methods and procedures to be followed, and the staffing and equipment 10 required, are vested exclusively in the Hospital, provided the Hospital shall not 11 exercise these rights in violation of the provisions of this Agreement. The parties 12 recognize that the above statement of management prerogatives is for illustrative purposes only and should not be construed as restrictive or interpreted so as to exclude those prerogatives not mentioned which are inherent to the management
