The Metering Requirement and Data clause establishes the obligations and standards for measuring and recording the usage or consumption of a particular resource, such as electricity, water, or gas, within the scope of an agreement. Metering Requirement and Data. All Products from the Units must be delivered through a single Electric Revenue Meter and that meter must be dedicated exclusively to the Units. All Energy must be measured by the Units’ Electric Revenue Meter to be eligible for payment under this Agreement. To support invoice settlement purposes, Seller shall provide Buyer with access to all real-time meters, billing meters and back-up meters (i.e., all metering). Seller shall authorize Buyer to view the on-line meter data from the Electric Revenue Meter. Within Schedule 3 of Seller’s Meter Service Agreement with the CAISO, Seller shall identify Buyer as an authorized user with “read only” privileges. [If the interconnecting Transmission Provider is not the CAISO, the prior sentence shall be modified accordingly.] [All Gas must be delivered through and measured by the Gas Meter. If such Gas Meter is not dedicated exclusively to a single Unit, then all Gas used by such Unit shall be measured by a Gas submeter]. In addition, Seller hereby agrees to provide all meter and submeter data to Buyer as set forth in Section 3.8(f). Seller consents to Buyer obtaining from the Transmission Provider the Electric Revenue Meter data, [and from the interconnecting Gas pipeline all Gas Meter data], applicable to the Units and all inspection, testing and calibration data and reports and agrees to provide to Buyer all meter data, inspection, testing and calibration data and reports for the submeter(s). If the Transmission Provider makes any adjustment to any Electric Revenue Meter data for a given time period, [or if the interconnecting pipeline makes any adjustment to any Gas Meter data for a given time period,] Buyer shall incorporate such revisions in its next monthly invoices, if applicable, pursuant to Section 6.1 (Billing and Payment), covering the entire applicable time period in order to conform fully such adjustments to the meter data. (If Seller is the recipient of the meter information, Seller shall promptly provide the meter information to Buyer.) Buyer shall submit any such revised invoice on the next date on which Buyer is to render an invoice in accordance with Section 6.1 provided that Buyer shall not be required to render an invoice sooner than twenty (20) days after the date on which Buyer receives such binding adjustment to the meter data.   • ORDERING REQUIREMENTS Eligible Purchasers shall order Goods and/or Services from this Contract, consistent with the terms hereof and by using any ordering mechanism agreeable both to Contractor and Purchaser but including, at a minimum, a purchase order. When practicable, Contractor and Purchaser also shall use telephone orders, email orders, web- based orders, and similar procurement methods (collectively “Purchaser Order”). All Purchase Orders must reference the Contract number. The terms of this Contract shall apply to any Purchase Order and, in the event of any conflict, the terms of this Contract shall prevail. Notwithstanding any provision to the contrary, in no event shall any ‘click-agreement,’ software or web-based application terms and conditions, or any other agreement modify the terms and conditions of this Contract.

  • Monitoring Requirements This Schedule sets out the contract management requirements which are applicable to the delivery of the Services.

  • Screening Requirements LFAC shall ensure that all prospective and current Covered Persons are not Ineligible Persons, by implementing the following screening requirements. a. LFAC shall screen all prospective Covered Persons against the Exclusion List prior to engaging their services and, as part of the hiring or contracting process, shall require such Covered Persons to disclose whether they are Ineligible Persons. b. LFAC shall screen all current Covered Persons against the Exclusion List within 30 days after the Effective Date and on a monthly basis thereafter. c. LFAC shall require all Covered Persons to disclose immediately if they become an Ineligible Person. LFAC shall maintain documentation (i.e., a print screen of the search results) in order to demonstrate that LFAC: (1) has checked the Exclusion List and determined that its Covered Persons are not Ineligible Persons; and (2) has required its Covered Persons to disclose if they are an Ineligible Person. Nothing in this Section III.D affects LFAC’s responsibility to refrain from (and liability for) billing Federal health care programs for items or services furnished, ordered, or prescribed by an excluded person. LFAC understands that items or services furnished by excluded persons are not payable by Federal health care programs and that LFAC may be liable for overpayments and/or criminal, civil, and administrative sanctions for employing or contracting with an excluded person regardless of whether LFAC meets the requirements of Section III.D.

  • Conference Requirement and Procedure (i) The Employer, or the Employer’s representative, shall, when requested by the Employees or their Employee Representative/ Union Delegate, confer (within a reasonable period of time which should not exceed 1/2 hour) for the purpose of determining whether or not conditions are inclement. (ii) Provided that if the Employer or the Employers’ representative refuses to confer within such reasonable period, Employees shall be entitled to cease work for the rest of the day and be paid Inclement Weather.
