Metropolitan Area Clause Samples
The 'Metropolitan Area' clause defines the specific geographic region, typically encompassing a central city and its surrounding suburbs, that is relevant to the agreement. This clause clarifies which locations are included within the metropolitan area for the purposes of the contract, such as determining service coverage, delivery zones, or jurisdiction for legal matters. By clearly outlining the boundaries of the metropolitan area, the clause ensures both parties have a shared understanding of the locations affected by the agreement, thereby preventing disputes over geographic scope.
Metropolitan Area. “Metropolitan Area” shall mean an area designated as such by the Office of Management and Budget pursuant to 44 U.S.C. 3504(e) and 31 U.S.C. 1104(d) and Executive Order 10253 (3 CFR 1949-1953 Comp., p.758), as amended.
Metropolitan Area. When employed on work located within a radius of 50 kilometres from the G.P.O. Adelaide.
Metropolitan Area. When employed on work located within a radius of 40 kilometres from the G.P.O. Adelaide.
Metropolitan Area. The Metropolitan Area is:
(1) For productions shot on video: the territory within a twenty-five (25)-kilometre radius from:
a) The ▇▇▇▇▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇▇▇ in Montreal, for production companies whose head office is located within a forty (40) kilometre radius of that ▇▇▇▇▇ ▇▇▇▇▇▇▇;
b) Laval University in Quebec City, for production companies whose head office is located within a forty (40) kilometre radius of Laval University;
c) The head office of the production firm, for production companies whose head office is located outside the areas described in (a) and (b). A twenty-five (25)-kilometre journey by road is added to the distances mentioned in paragraphs (a), (b), (c) above.
(2) For productions shot on film: the territory:
a) On the islands of Montreal, Laval, Bizard and Perrot;
b) In the municipalities of Verchères, Mont St-Hilaire, Hudson, Vaudreuil and St-Lazare;
c) In the Oka recreational park;
d) On the territory of the Mirabel Airport facilities; and
e) Within a twenty-five (25)-kilometre radius: Of the ▇▇▇▇▇▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇▇▇, for a Director who resides in the Montreal area; From Place Jacques-Cartier, for a Director who resides in the Quebec City area.
Metropolitan Area. A. Wage-earners
Metropolitan Area the Metropolitan Region of Rio de Janeiro, a regional unit established by State Complementary Law no. 184/2018, composed by the State of Rio de Janeiro together with the Municipalities of Rio de Janeiro, ▇▇▇▇▇▇▇ Roxo, Cachoeiras de Macacu, ▇▇▇▇▇ de Caxias, Guapimirim, Itaboraí, Itaguaí, Japeri, Magé, Maricá, Mesquita, Nilópolis, Niterói, Nova Iguaçu, Paracambi, Petrópolis, Queimados, Rio Bonito, São Gonçalo, São João de Meriti, Seropédica and Tanguá, with a view to the organization, planning and performance of public duties and services of metropolitan or common interest.
Metropolitan Area. The decision of the arbitrators shall be final and conclusive upon the parties. Payment of fees and costs may be awarded at the discretion of the arbitrators. Judgment upon an award rendered by the arbitrators may be entered in any court of competent jurisdiction.
Metropolitan Area.
(a) within the limits set forth in Appendix 7, when the Director's services or Second Unit Director’s services are retained by a producer whose head office is located in the greater Montreal area, in which case the reference point is Berri UQAM station;
(b) within the limits set out in Appendix 8, when the Director’s services or Second Unit Director’s services are retained by a producer whose head office is located in the Quebec City metropolitan area, in which case the reference point is the intersection of the ▇▇▇▇▇▇-▇▇▇▇▇▇▇▇ autoroute and boulevard Laurier (i.e. Université Laval); or
(c) in all other cases, at a distance of thirty (30) kilometers by road or less from the producer's head office.
Metropolitan Area. Syntel agrees that it will not relocate the Syntel Service Centers, nor establish a satellite facility for providing Services hereunder, without first obtaining the written consent of AH, which consent shall not be unreasonably withheld. AH and Syntel agree that currently the Services will be performed from a Syntel facility in Mumbai, India and a Syntel facility in Cary, North Carolina.
5.03 Syntel will adhere to all material AH practices and standards identified to it and further agrees to use its best efforts to adhere to all practices and standards concerning access to the mainframes located at the mainframe complex located at 2 Pe▇▇▇▇▇▇▇ ▇▇▇▇ ▇▇▇▇, ▇▇▇▇▇▇▇▇▇▇, ▇▇▇ ▇▇▇▇▇▇ (▇▇e "AH Data Center") as outlined in the American International Group Data Center, Inc. Manual, as amended from time to time, provided however, Syntel shall be responsible for only those changes to practices and standards for which it receives prior notice sufficient for it to act upon. A copy of the manual which is in effect will be available at all times for Syntel.
5.04 Syntel shall be solely responsible for establishing and maintaining connections from Syntel Service Centers to AH facilities to provide the Services including without limitation all telecommunications equipment, all telephone and other telecommunications lines and all expenses associated with transmission of data from Syntel's Service Centers to AH facilities. Syntel will use reasonable efforts to provide the appropriate line capacity to assure the efficient use of resources. See also Section 4.06.
Metropolitan Area. When employed on work located within a radius of 50 kilometres radius from the employee’s home depot/yard. Where such location falls within a 50km radius of a capital city GPO, the radial area will be taken to be the radial area from the GPO.
