Common use of Minimisation of Impact Clause in Contracts

Minimisation of Impact. Upon receiving a notice the parties will meet to discuss and agree: I. What action can be taken to minimise the effect of the force majeure event on the performance by the affected obligation II. Whether the affected party is able to work around the force majeure event either to prevent the delay in the performance of the affected obligations or to minimise the impact of that delay; and III. What modifications or additions to the terms of this Agreement or any other agreements between the parties (including without limitation any modifications or additions relating to the appointment of any additional costs) are required to give effect to any proposal to minimise the effect of the force majeure event.
