Common use of Minimum Guarantee Clause in Contracts

Minimum Guarantee. (A) All Regularly Assigned Employees shall receive in wages not less than eighty-four (84) times the employee's basic straight-time rate for each bi-weekly pay period. Minimum guarantee will not apply if the employee only works the first day of the pay period when entering or leaving a yard. (B) All Relief Employees, RAREs and DRAEs shall receive in wages not less than eighty-four (84) hours straight-time pay for each assignment. (C) Holiday Premium Pay, overtime worked beyond the basic straight-time day and the premium portion of overtime shall be paid in addition to the guarantee. (D) The above shall not apply to crew members engaged as seasonals or extras to relieve crew members for vacations, illness or leaves of absence.
