Common use of Mitigation of Delay Clause in Contracts

Mitigation of Delay. The Contractor has a duty to mitigate the effect, of Employer risk events, on the works and the Contractor does all it reasonably can to avoid an impact on the Prices. The duty to mitigate does not extend to the Contractor to adding extra resources or to work outside its planned working hours.
