Common use of Mitigation; Offset Clause in Contracts

Mitigation; Offset. Executive shall not be required to mitigate the amount of any payment or benefit provided for in the Agreement by seeking other employment or otherwise. However, any amount payable pursuant to this Agreement following the termination of Executive's employment shall reduce any amount payable by Employer to or with respect to Executive pursuant to any other severance pay or other similar plan, program or arrangement of Employer, including, without limitation, the Employer's Master Severance Plan for Key Employees.
