Common use of MONTH TO MONTH TENANCY Clause in Contracts

MONTH TO MONTH TENANCY. If with Landlord’s prior written consent, which may be withheld in Landlord’s sole discretion, Tenant remains in possession of the Premises after the expiration or other termination of the Term, Tenant shall be deemed to be occupying the Premises on a month-to-month tenancy only, at a monthly rental equal to 150% of the last monthly installment of Annual Rent and Occupancy Costs of the Term as determined in accordance with Article 4.00, and such month-to-month tenancy may be terminated by Landlord or Tenant on the last day of any calendar month by delivery of at least 30 days advance notice of termination to the other.

If If, with the Landlord’s prior written consent, which may be withheld in Landlord’s sole discretion, the Tenant remains in possession of the Premises after the expiration or other termination of the Term, the Tenant shall be deemed to be occupying the Premises on a month-to-month tenancy only, at a monthly rental equal to 150% of one and one quarter times the Base Rent payable by the Tenant in the last monthly installment of Annual Rent and Occupancy Costs month of the Term or such other rental as determined is stated in accordance with Article 4.00such written consent, and such month-to-month tenancy may be terminated by the Landlord or the Tenant on the last day of any calendar month by delivery of at least 30 days thirty (30) days’ advance written notice of termination to the other, as the case may be.

If If, with the Landlord’s prior written consent, which may be withheld in Landlord’s sole discretion, the Tenant remains in possession of the Premises after the expiration or other termination of the TermTerm without any further written agreement with the Landlord allowing it to do so, the Tenant shall be deemed to be occupying the Premises on a month-to-month tenancy only, at a monthly rental equal to 150125% of the Base Rent payable by the Tenant in the last monthly installment of Annual Rent and Occupancy Costs month of the Term or such other rental as determined is stated in accordance with Article 4.00such written consent, and such month-to-month tenancy may be terminated by the Landlord or the Tenant on the last day of any calendar month by delivery of at least 30 days thirty (30) days’ advance written notice of termination to the other.
