Common use of Network Interface Device Clause in Contracts

Network Interface Device. 9.1 Subject to the conditions set forth in Section 1 of this Attachment and upon request by Intrado, Verizon shall permit Intrado to connect an Intrado Loop to the Inside Wiring of a Customer's premises through the use of a Verizon NID in accordance with this Section 9 and the rates and charges provided in the Pricing Attachment. Verizon shall provide Intrado with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling Rules. Intrado may access a Verizon NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado NID deployed by Intrado or, if an entrance module is available in the Verizon NID, by connecting an Intrado Loop to the Verizon NID. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Intrado access, remove, disconnect or in any other way rearrange Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Intrado access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Intrado remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Intrado remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 When Intrado is connecting an Intrado-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado does not need to submit a request to Verizon and Verizon shall not charge Intrado for access to the Verizon NID. In such instances, Intrado shall comply with the provisions of Sections 9.2 through 9.7 of this Attachment and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 of this Attachment. 9.8 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado may access the Customer’s Inside Wiring, acting as the agent of the Customer by any of the following means: 9.8.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Intrado may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado may request Verizon to make other rearrangements to the Inside Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Intrado, its agent, the building owner or the Customer). If Intrado accesses the Customer’s Inside Wiring as described in this Section 9.8.3, time and materials charges will be billed to the requesting party (i.e. Intrado, its agent, the building owner or the Customer).

Verizon shall provide Intrado with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling Rules. Intrado Exhibit B. AT&T may access a Verizon NID either by means of a connection Cross Connection (but only if the use of such connection Cross Connection is technically feasible) from an adjoining Intrado AT&T NID deployed by Intrado AT&T or, if an entrance module is available in the Verizon NID, by connecting an Intrado AT&T Loop to the Verizon NID. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. Verizon shall not be responsible for resolving any conflicts between AT&T and third party service providers for access to the Customer’s premises and Inside Wire. 9.2 11.3.2 In no case shall Intrado AT&T access, remove, disconnect or in any other way rearrange Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 11.3.3 In no case shall Intrado AT&T access, remove, disconnect or in any other way rearrange, rearrange a Customer’s Inside Wiring Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring is Wire continues to be used in the provision of ongoing Telecommunications Service by Verizon to that Customer. 9.4 11.3.4 In no case shall Intrado AT&T remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 11.3.5 In no case shall Intrado AT&T remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 11.3.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring Wire must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 11.3.7 When Intrado AT&T is connecting an IntradoAT&T-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado AT&T does not need to submit a request to Verizon and Verizon shall not charge Intrado AT&T for access to the Verizon NID. In such instances, Intrado AT&T shall comply with the provisions of Sections 9.2 11.3.2 through 9.7 11.3.6 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 11.3.7.1 of this AttachmentAgreement. 9.8 11.3.7.1 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado AT&T may access the Customer’s Inside WiringWire, acting as the agent of the Customer by any of the following means: 9.8.1 (a) Where an adequate length of Inside Wiring Wire is present and environmental conditions permit, Intrado requesting carrier (i.e., AT&T or AT&T’s agent, the building owner, or the Customer) may remove the Inside Wiring Wire from the Customer’s side of the Verizon NID and connect that Inside Wiring wire to IntradoAT&T’s NID.; 9.8.2 (b) Where an adequate length of Inside Wiring Wire is not present or environmental conditions do not permit, Intrado AT&T may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado (c) AT&T may request Verizon to make other rearrangements to the Inside Wiring Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoAT&T, its agent, the building owner or the Customer). Any conflicts between service providers for access to the Customer’s Inside Wiring Wire must be resolved by the person who controls use of the wiring wire (e.g., the Customer). 9.7 When Intrado Tech Com is connecting an Intradoa Tech Com-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado Tech Com does not need to submit a request to Verizon and Verizon shall not charge Intrado Tech Com for access to the Verizon NID. In such instances, Intrado Tech Com shall comply with the provisions of Sections 9.2 through 9.7 9.8 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 6 of this AttachmentAgreement. 9.8 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado Tech Com may access the Customer’s Inside WiringWire, acting as the agent of the Customer by any of the following means: 9.8.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring Wire is not present or environmental conditions do not permit, Intrado Tech Com may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado 9.8.2 Tech Com may request Verizon to make other rearrangements to the Inside Wiring Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoTech Com, its agent, the building owner or the Customer). If Intrado Tech Com accesses the Customer’s Inside Wiring Wire as described in this Section 9.8.39.8.2, time and materials charges will be billed to the requesting party (i.e. IntradoTech Com, its agent, the building owner or the Customer).

Network Interface Device. 9.1 1. Subject to the conditions set forth in Section 1 of this Attachment and upon request by Intrado1, at Cinergy’s request, Verizon shall permit Intrado Cinergy to connect an Intrado a Cinergy Loop to the Inside Wiring of a Customer's premises Customer through the use of a Verizon NID in accordance with this Section 9 and the rates and charges provided in the Pricing Attachment. Verizon shall provide Intrado Cinergy with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado Cinergy may access a Verizon NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado Cinergy NID deployed by Intrado Cinergy or, if an entrance module is available in the Verizon NID, by connecting an Intrado a Cinergy Loop to the Verizon NID. In all cases, Verizon shall perform this connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 2. In no case shall Intrado Cinergy access, remove, disconnect or in any other way rearrange rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 3. In no case shall Intrado Cinergy access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 4. In no case shall Intrado Cinergy remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 5. In no case shall Intrado Cinergy remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 6. Maintenance and control of premises Inside Wiring is the responsibility of the Customer.
