Common use of Network Interface Device Clause in Contracts

Network Interface Device. 9.1 Subject to the conditions set forth in Section 1 of this Attachment and upon request by Intrado, Verizon shall permit Intrado to connect an Intrado Loop to the Inside Wiring of a Customer's premises through the use of a Verizon NID in accordance with this Section 9 and the rates and charges provided in the Pricing Attachment. Verizon shall provide Intrado with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling Rules. Intrado may access a Verizon NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado NID deployed by Intrado or, if an entrance module is available in the Verizon NID, by connecting an Intrado Loop to the Verizon NID. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Intrado access, remove, disconnect or in any other way rearrange Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Intrado access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Intrado remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Intrado remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 When Intrado is connecting an Intrado-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado does not need to submit a request to Verizon and Verizon shall not charge Intrado for access to the Verizon NID. In such instances, Intrado shall comply with the provisions of Sections 9.2 through 9.7 of this Attachment and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 of this Attachment. 9.8 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado may access the Customer’s Inside Wiring, acting as the agent of the Customer by any of the following means: 9.8.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Intrado may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado may request Verizon to make other rearrangements to the Inside Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. Intrado, its agent, the building owner or the Customer). If Intrado accesses the Customer’s Inside Wiring as described in this Section 9.8.3, time and materials charges will be billed to the requesting party (i.e. Intrado, its agent, the building owner or the Customer).

Network Interface Device. 9.1 92.1 Subject to the conditions set forth in Section 1 of this Attachment and upon request by Intrado85, Verizon at SOUTHEAST’s request, ALLTEL shall permit Intrado SOUTHEAST to connect an Intrado a SOUTHEAST Loop to the Inside Wiring of a Customer's premises Customer through the use of a Verizon ALLTEL NID in accordance with this Section 9 92 and the rates and charges provided in the Pricing Attachment. Verizon ALLTEL shall provide Intrado SOUTHEAST with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado SOUTHEAST may access a Verizon ALLTEL NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado SOUTHEAST NID deployed by Intrado SOUTHEAST or, if an entrance module is available in the Verizon ALLTEL NID, by connecting an Intrado a SOUTHEAST Loop to the Verizon ALLTEL NID. In all cases, ALLTEL shall perform this connection. When necessary, Verizon ALLTEL will rearrange its facilities to provide access to an existing Customer’s Inside Wire. Any conflicts between service providers for access to the Customer’s Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 92.7 When Intrado SOUTHEAST is connecting an Intradoa SOUTHEAST-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon ALLTEL NID, Intrado SOUTHEAST does not need to submit a request to Verizon ALLTEL and Verizon ALLTEL shall not charge Intrado SOUTHEAST for access to the Verizon ALLTEL NID. In such instances, Intrado SOUTHEAST shall comply with the provisions of Sections 9.2 92.2 through 9.7 92.7 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 92.8 of this AttachmentAgreement. 9.8 92.8 Due to the wide variety of NIDs utilized by Verizon ALLTEL (based on Customer size and environmental considerations), Intrado SOUTHEAST may access the Customer’s Inside Wiring, acting as the agent of the Customer by any of the following means: 9.8.1 92.8.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado SOUTHEAST may remove the Inside Wiring from the Customer’s side of the Verizon ALLTEL NID and connect that Inside Wiring to IntradoSOUTHEAST’s NID. 9.8.2 92.8.2 Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Intrado SOUTHEAST may enter the Customer side of the Verizon ALLTEL NID enclosure for the purpose of removing the Inside Wiring from the terminals of VerizonALLTEL’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring within the space of the Customer side of the Verizon ALLTEL NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon ALLTEL NID. 9.8.3 Intrado . 92.8.3 SOUTHEAST may request Verizon ALLTEL to make other rearrangements to the Inside Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoSOUTHEAST, its agent, the building owner or the Customer). If Intrado SOUTHEAST accesses the Customer’s Inside Wiring as described in this Section 9.8.392.8.3, time and materials charges will be billed to the requesting party (i.e. IntradoSOUTHEAST, its agent, the building owner or the Customer).

Verizon shall provide Intrado AURA with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado AURA may access a Verizon NID either by means of a connection Cross Connection (but only if the use of such connection Cross Connection is technically feasible) from an adjoining Intrado AURA NID deployed by Intrado AURA or, if an entrance module is available in the Verizon NID, by connecting an Intrado a AURA Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Intrado AURA access, remove, disconnect or in any other way rearrange rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Intrado AURA access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring Wire is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Intrado AURA remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Intrado AURA remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring Wire must be resolved by the person who controls use of the wiring wire (e.g., the Customer). 9.7 . When Intrado AURA is connecting an Intradoa AURA-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado AURA does not need to submit a request to Verizon and Verizon shall not charge Intrado AURA for access to the Verizon NID. In such instances, Intrado AURA shall comply with the provisions of Sections 9.2 through 9.7 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 6 of this AttachmentAgreement. 9.8 9.7 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado AURA may access the Customer’s Inside WiringWire, acting as the agent of the Customer by any of the following means: 9.8.1 9.7.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring Wire is not present or environmental conditions do not permit, Intrado AURA may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado 9.7.2 AURA may request Verizon to make other rearrangements to the Inside Wiring Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoAURA, its agent, the building owner or the Customer). If Intrado AURA accesses the Customer’s Inside Wiring Wire as described in this Section 9.8.39.7.2, time and materials charges will be billed to the requesting party (i.e. IntradoAURA, its agent, the building owner or the Customer).

Verizon shall provide Intrado Reconex with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado Reconex may access a Verizon NID either by means of a connection Cross Connection (but only if the use of such connection Cross Connection is technically feasible) from an adjoining Intrado Reconex NID deployed by Intrado Reconex or, if an entrance module is available in the Verizon NID, by connecting an Intrado a Reconex Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Intrado Reconex access, remove, disconnect or in any other way rearrange rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Intrado Reconex access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring Wire is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Intrado Reconex remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Intrado Reconex remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring Wire must be resolved by the person who controls use of the wiring wire (e.g., the Customer). 9.7 . When Intrado Reconex is connecting an Intradoa Reconex-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado Reconex does not need to submit a request to Verizon and Verizon shall not charge Intrado Reconex for access to the Verizon NID. In such instances, Intrado Reconex shall comply with the provisions of Sections 9.2 through 9.7 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 7 of this AttachmentAgreement. 9.8 9.7 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado Reconex may access the Customer’s Inside WiringWire, acting as the agent of the Customer by any of the following means: 9.8.1 9.7.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring Wire is not present or environmental conditions do not permit, Intrado Reconex may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado 9.7.2 Reconex may request Verizon to make other rearrangements to the Inside Wiring Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoReconex, its agent, the building owner or the Customer). If Intrado Reconex accesses the Customer’s Inside Wiring Wire as described in this Section 9.8.39.7.2, time and materials charges will be billed to the requesting party (i.e. IntradoReconex, its agent, the building owner or the Customer).

Network Interface Device. 9.1 11.3.1 Subject to the conditions set forth in Section 1 of this Attachment 11.7 and upon request by Intradoat AT&T’s request, Verizon shall permit Intrado AT&T to connect an Intrado AT&T Loop to the Inside Wiring of a Customer's premises Customer through the use of a Verizon NID in accordance with the manner set forth in this Section 9 11.3, or at any other technically feasible point, if any, as required by Applicable Law and, in such case, pursuant to Section 11.8 and the rates and charges provided in the Pricing Attachment. Verizon shall provide Intrado with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling Rules. Intrado Exhibit B. AT&T may access a Verizon NID either by means of a connection Cross Connection (but only if the use of such connection Cross Connection is technically feasible) from an adjoining Intrado AT&T NID deployed by Intrado AT&T or, if an entrance module is available in the Verizon NID, by connecting an Intrado AT&T Loop to the Verizon NID. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. Verizon shall not be responsible for resolving any conflicts between AT&T and third party service providers for access to the Customer’s premises and Inside Wire. 9.2 11.3.2 In no case shall Intrado AT&T access, remove, disconnect or in any other way rearrange Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 11.3.3 In no case shall Intrado AT&T access, remove, disconnect or in any other way rearrange, rearrange a Customer’s Inside Wiring Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring is Wire continues to be used in the provision of ongoing Telecommunications Service by Verizon to that Customer. 9.4 11.3.4 In no case shall Intrado AT&T remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 11.3.5 In no case shall Intrado AT&T remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 11.3.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring Wire must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 11.3.7 When Intrado AT&T is connecting an IntradoAT&T-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado AT&T does not need to submit a request to Verizon and Verizon shall not charge Intrado AT&T for access to the Verizon NID. In such instances, Intrado AT&T shall comply with the provisions of Sections 9.2 11.3.2 through 9.7 11.3.6 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 11.3.7.1 of this AttachmentAgreement. 9.8 11.3.7.1 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado AT&T may access the Customer’s Inside WiringWire, acting as the agent of the Customer by any of the following means: 9.8.1 (a) Where an adequate length of Inside Wiring Wire is present and environmental conditions permit, Intrado requesting carrier (i.e., AT&T or AT&T’s agent, the building owner, or the Customer) may remove the Inside Wiring Wire from the Customer’s side of the Verizon NID and connect that Inside Wiring wire to IntradoAT&T’s NID.; 9.8.2 (b) Where an adequate length of Inside Wiring Wire is not present or environmental conditions do not permit, Intrado AT&T may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado (c) AT&T may request Verizon to make other rearrangements to the Inside Wiring Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoAT&T, its agent, the building owner or the Customer). If Intrado AT&T accesses the Customer’s Inside Wiring Wire as described in this Section 9.8.311.3.7.1(c), time and materials charges will be billed to the requesting party (i.e. IntradoAT&T, its agent, the building owner or the Customer).

Verizon shall provide Intrado Pac-West with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado Pac-West may access a Verizon NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado Pac-West NID deployed by Intrado Pac-West or, if an entrance module is available in the Verizon NID, by connecting an Intrado a Pac-West Loop to the Verizon NID. In all cases, Verizon shall perform this connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s 's Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 . In no case shall Intrado either Party access, remove, disconnect or in any other way rearrange Verizon’s rearrange, Loop facilities from Verizon’s the other Party's NIDs, enclosures, or protectors. 9.3 . In no case shall Intrado either Party access, remove, disconnect or in any other way rearrange, a Customer’s 's Inside Wiring from Verizon’s the other Party's NIDs, enclosures, or protectors where such Customer Inside Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 . In no case shall Intrado either Party remove or disconnect ground wires from Verizon’s the other Party's NIDs, enclosures, or protectors. 9.5 . In no case shall Intrado either Party remove or disconnect NID modules, protectors, or terminals from Verizon’s the other Party's NID enclosures. 9.6 . Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s 's Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 . When Intrado Pac-West is connecting an Intradoa Pac-West-provided Loop to the Inside Wiring of a Customer’s 's premises through the Customer’s 's side of the Verizon NID, Intrado Pac-West does not need to submit a request to Verizon and Verizon shall not charge Intrado Pac-West for access to the Verizon NID. In such instances, Intrado Pac-West shall comply with the provisions of Sections 9.2 through 9.7 of this Attachment Agreement and shall access the Customer’s 's Inside Wire in the manner set forth in Section 9.8 of this Attachment. 9.8 Agreement. Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado Pac-West may access the Customer’s 's Inside Wiring, acting as the agent of the Customer by any of the following means: 9.8.1 : Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado Pac-West may remove the Inside Wiring from the Customer’s 's side of the Verizon NID and connect that Inside Wiring to Intrado’s Pac-West's NID. 9.8.2 . Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Intrado Pac-West may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring from the terminals of Verizon’s 's NID and connecting a connectorized or spliced jumper wire from a suitable “"punch out” " hole of such NID enclosure to the Inside Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado . Pac-West may request Verizon to make other rearrangements to the Inside Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoPac-West, its agent, the building owner or the Customer). If Intrado Pac-West accesses the Customer’s 's Inside Wiring as described in this Section 9.8.3, time and materials charges will be billed to the requesting party (i.e. IntradoPac-West, its agent, the building owner or the Customer).

Verizon shall provide Intrado ICG with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado ICG may access a Verizon NID either by means of a connection Cross Connection (but only if the use of such connection Cross Connection is technically feasible) from an adjoining Intrado ICG NID deployed by Intrado ICG or, if an entrance module is available in the Verizon NID, by connecting an Intrado a ICG Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. Any conflicts between service providers for access to the Customer’s Inside Wiring Wire must be resolved by the person who controls use of the wiring wire (e.g., the Customer). 9.7 . When Intrado ICG is connecting an IntradoICG-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado ICG does not need to submit a request to Verizon and Verizon shall not charge Intrado ICG for access to the Verizon NID. In such instances, Intrado ICG shall comply with the of provisions of Sections 9.2 through 9.7 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 7 of this AttachmentAgreement. 9.8 9.7 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado ICG may access the Customer’s Inside WiringWire, acting as the agent of the Customer by any of the following means:means:‌ 9.8.1 9.7.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring Wire is not present or environmental conditions do not permit, Intrado ICG may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado 9.7.2 ICG may request Verizon to make other rearrangements to the Inside Wiring Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoICG, its agent, the building owner or the Customer). If Intrado ICG accesses the Customer’s Inside Wiring Wire as described in this Section 9.8.39.7.2, time and materials charges will be billed to the requesting party (i.e. IntradoICG, its agent, the building owner or the Customer).Customer).‌

Network Interface Device. 9.1 Subject to the conditions set forth in Section 1 of this Attachment and upon request by IntradoNUI, Verizon shall permit Intrado NUI to connect an Intrado a NUI Loop to the Inside Wiring of a Customer's ’s premises through the use of a Verizon NID in accordance with this Section 9 and the rates and charges provided in the Pricing Attachment. Verizon shall provide Intrado NUI with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado NUI may access a Verizon NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado NUI NID deployed by Intrado NUI or, if an entrance module is available in the Verizon NID, by connecting an Intrado a NUI Loop to the Verizon NID. In all cases, Verizon shall perform this connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. Any conflicts between service providers for access to the Customer’s Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 When Intrado NUI is connecting an Intradoa NUI-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado NUI does not need to submit a request to Verizon and Verizon shall not charge Intrado NUI for access to the Verizon NID. Verizon shall provide Intrado D&E with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado D&E may access a Verizon NID either by means of a connection Cross Connection (but only if the use of such connection Cross Connection is technically feasible) from an adjoining Intrado D&E NID deployed by Intrado D&E or, if an entrance module is available in the Verizon NID, by connecting an Intrado a D&E Loop to the Verizon NID. In all cases, Verizon shall perform this Cross Connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Intrado D&E access, remove, disconnect or in any other way rearrange rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 In no case shall Intrado D&E access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring Wire from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring Wire is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Intrado D&E remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 In no case shall Intrado D&E remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Intrado Onvoy may access a Verizon Frontier NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado Onvoy NID deployed by Intrado Onvoy or, if an entrance module is available in the Verizon Frontier NID, by connecting an Intrado Onvoy Loop to the Verizon Frontier NID. When necessary, Verizon Frontier will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 In no case shall Intrado Onvoy access, remove, disconnect or in any other way rearrange VerizonFrontier’s Loop facilities from VerizonFrontier’s NIDs, enclosures, or protectors.protectors.‌ 9.3 In no case shall Intrado Onvoy access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring from VerizonFrontier’s NIDs, enclosures, or protectors where such Customer Inside Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 In no case shall Intrado Onvoy remove or disconnect ground wires from VerizonFrontier’s NIDs, enclosures, or protectors. 9.5 In no case shall Intrado Onvoy remove or disconnect NID modules, protectors, or terminals from VerizonFrontier’s NID enclosures. 9.6 Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 When Intrado Onvoy is connecting an IntradoOnvoy-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon Frontier NID, Intrado Onvoy does not need to submit a request to Verizon Frontier and Verizon Frontier shall not charge Intrado Onvoy for access to the Verizon Frontier NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon Frontier NID. 9.8.3 Intrado Onvoy may request Verizon Frontier to make other rearrangements to the Inside Wiring terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoOnvoy, its agent, the building owner or the Customer). If Intrado Onvoy accesses the Customer’s Inside Wiring as described in this Section 9.8.3, time and materials charges will be billed billed‌ to the requesting party (i.e. IntradoOnvoy, its agent, the building owner or the Customer).

In all cases, Verizon shall perform this connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 2.2.6. When Intrado LightWave is connecting an Intradoa LightWave-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado LightWave does not need to submit a request to Verizon and Verizon shall not charge Intrado LightWave for access to the Verizon NID. In such instances, Intrado LightWave shall comply with the provisions of Sections 9.2 2.2.1 through 9.7 2.2.6 of this UNE Remand Attachment and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 2.2.7 of this UNE Remand Attachment. 9.8 2.2.7. Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado LightWave may access the Customer’s Inside Wiring, acting as the agent of the Customer by any of the following means: 9.8.1 2.2.8. Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado LightWave may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to IntradoLightWave’s NID. 9.8.2 2.2.9. Where an adequate length of Inside Wiring is not present or environmental conditions do not permit, Intrado LightWave may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID.NID.‌‌‌‌‌ 9.8.3 Intrado 2.2.10. If Intrado LightWave accesses the Customer’s Inside Wiring as described in this Section 9.8.32.2.10, time and materials charges will be billed to the requesting party (i.e. IntradoLightWave, its agent, the building owner or the Customer).

In such instances, Intrado Tech Com shall comply with the provisions of Sections 9.2 through 9.7 9.8 of this Attachment Agreement and shall access the Customer’s Inside Wire in the manner set forth in Section 9.8 6 of this AttachmentAgreement. 9.8 Due to the wide variety of NIDs utilized by Verizon (based on Customer size and environmental considerations), Intrado Tech Com may access the Customer’s Inside WiringWire, acting as the agent of the Customer by any of the following means: 9.8.1 Where an adequate length of Inside Wiring is present and environmental conditions permit, Intrado may remove the Inside Wiring from the Customer’s side of the Verizon NID and connect that Inside Wiring to Intrado’s NID. 9.8.2 Where an adequate length of Inside Wiring Wire is not present or environmental conditions do not permit, Intrado Tech Com may enter the Customer side of the Verizon NID enclosure for the purpose of removing the Inside Wiring Wire from the terminals of Verizon’s NID and connecting a connectorized or spliced jumper wire from a suitable “punch out” hole of such NID enclosure to the Inside Wiring Wire within the space of the Customer side of the Verizon NID. Such connection shall be electrically insulated and shall not make any contact with the connection points or terminals within the Customer side of the Verizon NID. 9.8.3 Intrado 9.8.2 Tech Com may request Verizon to make other rearrangements to the Inside Wiring Wire terminations or terminal enclosure on a time and materials cost basis to be charged to the requesting party (i.e. IntradoTech Com, its agent, the building owner or the Customer). If Intrado Tech Com accesses the Customer’s Inside Wiring Wire as described in this Section 9.8.39.8.2, time and materials charges will be billed to the requesting party (i.e. IntradoTech Com, its agent, the building owner or the Customer).

Network Interface Device. 9.1 1. Subject to the conditions set forth in Section 1 of this Attachment and upon request by Intrado1, at Cinergy’s request, Verizon shall permit Intrado Cinergy to connect an Intrado a Cinergy Loop to the Inside Wiring of a Customer's premises Customer through the use of a Verizon NID in accordance with this Section 9 and the rates and charges provided in the Pricing Attachment. Verizon shall provide Intrado Cinergy with access to NIDs in accordance with, but only to the extent required by, the Federal Unbundling RulesApplicable Law. Intrado Cinergy may access a Verizon NID either by means of a connection (but only if the use of such connection is technically feasible) from an adjoining Intrado Cinergy NID deployed by Intrado Cinergy or, if an entrance module is available in the Verizon NID, by connecting an Intrado a Cinergy Loop to the Verizon NID. In all cases, Verizon shall perform this connection. When necessary, Verizon will rearrange its facilities to provide access to an existing Customer’s Inside Wire. An entrance module is available only if facilities are not connected to it. 9.2 2. In no case shall Intrado Cinergy access, remove, disconnect or in any other way rearrange rearrange, Verizon’s Loop facilities from Verizon’s NIDs, enclosures, or protectors. 9.3 3. In no case shall Intrado Cinergy access, remove, disconnect or in any other way rearrange, a Customer’s Inside Wiring from Verizon’s NIDs, enclosures, or protectors where such Customer Inside Wiring is used in the provision of ongoing Telecommunications Service to that Customer. 9.4 4. In no case shall Intrado Cinergy remove or disconnect ground wires from Verizon’s NIDs, enclosures, or protectors. 9.5 5. In no case shall Intrado Cinergy remove or disconnect NID modules, protectors, or terminals from Verizon’s NID enclosures. 9.6 6. Maintenance and control of premises Inside Wiring is the responsibility of the Customer. Any conflicts between service providers for access to the Customer’s Inside Wiring must be resolved by the person who controls use of the wiring (e.g., the Customer). 9.7 7. When Intrado Cinergy is connecting an Intradoa Cinergy-provided Loop to the Inside Wiring of a Customer’s premises through the Customer’s side of the Verizon NID, Intrado Cinergy does not need to submit a request to Verizon and Verizon shall not charge Intrado Cinergy for access to the Verizon NID.
