New Software Versions Clause Samples

The "New Software Versions" clause defines the terms under which updates, upgrades, or new releases of software are provided to the customer. Typically, this clause specifies whether the customer is entitled to receive new versions as part of their existing agreement or if additional fees apply, and may outline the process for accessing or installing these updates. Its core practical function is to set clear expectations regarding software maintenance and improvements, ensuring both parties understand their rights and obligations concerning future software enhancements.
New Software Versions. FarmFacts is entitled to replace the Additional Application with a new version/new release, provided that (i) the performance and functionality of the new version is equivalent to or better than the version/release being replaced, and (ii) the new version/release avoids disproportionate adjustments on your part (for eg. usage of a different operating system, or usage of more technically advanced hardware). It is stipulated that additional training may be required due to eventual minor modifications to the structure of the Additional Application or its user interface, and that such training is not a disproportionate adjustment in terms of the above section.
New Software Versions. 5.1 As part of this Agreement, and provided the Customer is not in breach of any of its obligations, the Customer shall have access to all new releases of the Software during the Subscription Period (as defined in clause 14). New software versions can contain new functionality as well as corrections of errors and malfunctions. The Supplier shall make these releases available to the Customer by supplying complete installation files downloadable from the Supplier’s web pages or from webpages/sites approved by the Supplier. 5.2 Along with every new release, "release notes” will be supplied which describe what has changed since the last release. Should the Customer need assistance when upgrading the Software, this will be subject to agreement and invoicing as set out in clause 3.

New Software Versions. Lighting Analysts reserves the right to release new versions, add or delete features, increase or decrease functionality, modify, update, completely discontinue, completely discontinue specific “versions” of any/all Software, create major feature additions, additional or enhanced functionality, or other significant new or changed features of the Software, and the right to update, repair, patch, or otherwise fix the Software at any time with or without notice to All Users, as determined in Lighting Analysts’ sole discretion, and any such additional software shall be included in the definition of “Software” detailed herein. Should Lighting Analysts discontinue the Software, All Users will have a reasonable time to download their respective Content and/or Results, not to exceed a maximum of thirty (30) calendar days.
New Software Versions. New software versions or releases of the applicable Enterprise Storage Software are generally made available by Dell at no additional charge to licensees for Enterprise Storage Software that is installed on a Supported Product covered by a Dell limited hardware warranty or an applicable annual service or maintenance contract. New Versions include patches and bug fixes, changes that reflect an expansion or extension of existing features and changes that present new features, functions or capabilities.   • Antivirus software All workstations, laptops and other systems that process and/or store PHI COUNTY discloses to CONTRACTOR or CONTRACTOR creates, receives, maintains, or transmits on behalf of COUNTY must have installed and actively use comprehensive anti-virus software solution with automatic updates scheduled at least daily.

  • Software Updates ▇▇▇▇▇ agrees to keep current with software licensed from Skyward and will install new versions on a timeline approved by ▇▇▇▇▇ governance. This timeline will be communicated by NWRDC to the Districts.

  • Licensed Software Computer program(s) provided by Contractor in connection with the Deliverables, subject to Section 14 of this Contract.

  • Embedded Software To the extent any goods contain Embedded Software (defined below) that is not Buyer’s Property, no title to such Embedded Software shall pass to Buyer, and Supplier shall grant Buyer, its customers and all other users a non-exclusive worldwide, irrevocable, perpetual, royalty-free right to use, load, install, execute, demonstrate, market, test, resell, sublicense and distribute such Embedded Software as an integral part of such goods or for servicing the goods (the “Buyer-Required License”). If such Embedded Software or any part thereof is owned by a third party, prior to delivery, Supplier shall obtain the Buyer-Required License from such third-party owner. “Embedded Software” means software necessary for operation of goods and embedded in and delivered as an integral part of goods.

  • Server Software Subject to the terms and conditions of this ▇▇▇▇, Vocera grants you the non-exclusive right to (i) install and run (“Use”) the Server Software on computer systems (each, a “Server Computer”) located at End User’s Facilities in the geographic territory designated above (“Territory”); (ii) to Use the Client Software in conjunction with Authorized Client Devices and such Server Computers; and (iii) for pilot licenses for certain Software provided on a trial basis, use such Software for the limited term specified by Vocera in writing. You may Use the standard Server Software on one primary Server Computer (or a primary cluster of computers suitably configured for productive use of the Server Software). You may install backup copies of the Server Software on backup Server Computers to provide redundancy in the event of failure of the primary Server Computer(s) but, unless you have acquired additional licenses or a failover license from Vocera, you may not run such backup or additional copies concurrently with the primary copies. Vocera grants you the right to use the applicable License Key issued by Vocera only to enable Use of the Server Software in conjunction with the licensed Server Computers. Server Software may be licensed for a Subscription Term as specified in the Quote.
