Common use of No Borrowing Base Deficiency Clause in Contracts

No Borrowing Base Deficiency. A Borrowing Base Deficiency shall not exist after giving effect to the application of such Refunding Advance or Swing Line Advance; provided, however, that this provision shall not release the Liquidity Lenders from the obligation (upon receipt of a Borrowing Request in the appropriate amount) to make Refunding Advances or Swing Line Advances up to the amount of the then current Borrowing Base that would not cause a Borrowing Base Deficiency to exist.
