All classroom paraprofessionals are required to meet the highly qualified requirements of the No Child Left Behind Act no later than June 30, 2006. Those requirements are to have completed at least 2 years of higher education; obtained as Associates Degree; or demonstrate through an academic assessment using Work Keys, MTTC, etc., or through the Highly Qualified Paraprofessionals Portfolio option the knowledge and ability to assist in instructing. B. The District’s review committee will determine if the paraprofessional meets either of the highly qualified requirements through the use of the Michigan Department of Education of Education rubric and/or the successful completion of the Work Keys or MTTC assessments, or sixty (60) credit hours of coursework in high education. C. Paraprofessionals taking training, as approved by the Superintendent, in preparation for taking the academic assessment, shall be paid at their regular rate of pay in the event that the training is provided during non-regular work hours. D. If a paraprofessional has been determined by another school district or by the Michigan Department of Education as meeting the highly qualified requirements of the No Child Left Behind Act, then s/he shall be considered by the Oak Park School District as meeting the qualifications. E. In the event that any paraprofessional is unable to meet the requirements of the No Child Left Behind Act by the established deadline, s/he shall be laid off by the district with recall rights as established under the collective bargaining agreement. Paraprofessionals must meet the Highly Qualified requirements in order to fill an Instructional Aide position. F. All test scores related to the academic assessment taken by the paraprofessionals for the purpose of meeting the highly qualified requirements shall remain confidential. The only information to be shared with appropriate district personnel will be whether the paraprofessional passed or did not pass the assessment.

A. It is agreed that the time line for satisfying the requirements needed to meet the be a highly qualified requirements of teacher under the No Child Left Behind Act no later than June 30, 2006(NCLG/ESEA) depends upon when the bargaining unit member commenced employment with the District. Those requirements are to have completed at least 2 years Bargaining unit members hired on or after the beginning of higher education; obtained as Associates Degree; or demonstrate through an academic assessment using Work Keys, MTTC, etc., or through the Highly Qualified Paraprofessionals Portfolio option fall semester of 2002 must be highly qualified immediately and other bargaining unit members must be highly qualified by the knowledge and ability to assist in instructingend of the 2005-2006 school year.
B. C. The District’s review NCLB/ESEA provides different was for a teacher to be considered a highly qualified teacher. The Board and the Association will work together to inform all bargaining unit members about their options. To that end, a committee of two teachers appointed by the Association and two administrators shall be formed. The committee shall be named “The ESEA Committee” and shall study the credentials and assignments of all teachers in the District and issue a report by January 1, 2005 regarding which teachers meet/do not meet the ESEA requirements to be highly qualified. Teachers not meeting this standard will determine be informed of their options under the Act.
D. In grades K-5, highly qualified shall be defined as possessing the requisite certification and satisfying the provisions of the NCLB/ESEA pertaining to highly qualified teachers.
E. For teachers that are certified for all subjects in grades 6, 7, and 8, highly qualified shall mean that the teacher is a highly qualified teacher under the NCLB/ESEA. A teacher shall be assigned in their major or minor field of study unless assigning the teacher in the minor field of study contravenes the provisions of the NCLB/ESEA pertaining to highly qualified teachers.
F. In Grades 9 – 12, highly qualified shall be defined as possessing the requirements needed to be a highly qualified teacher under the NCLB/ESEA. A bargaining unit member shall be assigned in their major/minor field of study, unless this would contravene the provisions of the NCLB/ESEA pertaining to highly qualified teachers.
G. A teacher that has been recognized as highly qualified under the NCLB/ESEA by this school district or another Michigan school district shall be recognized as highly qualified by this school district for the duration of their employment.
H. Teachers not highly qualified for their assignment by the end of the 2005-2006 school year shall be granted the first vacancy that they apply for provided they are highly qualified for the vacancy. If there is no vacancy for which said teacher is highly qualified, said teacher shall be treated under the layoff and recall, Article XI, provisions of this Agreement as if their current position had been eliminated.
I. The District will facilitate teachers in becoming highly qualified through reasonable accommodations to the paraprofessional meets either teacher regarding release time and though paid graduated credit as provided under teacher compensation, Article XV. Teachers may, with the approval of the Superintendent, apply for up to six (6) hours of such credit.
J. No school improvement plan (SIP) provision shall alter, modify, violate or supersede, except as mutually agreed in writing by the Employer and the Association, this Agreement of any other formal or informal understanding, condition or practice established between the parties. The foregoing shall apply to any SIP the employer intends to implement.
K. Future legislation that removed, reduces or extends the date for compliance of the highly qualified teacher requirements through the use of the Michigan Department of Education of Education rubric and/or the successful completion of the Work Keys or MTTC assessments, or sixty (60) credit hours of coursework in high education.
