Non-Applicable Charges. The translation of all documents during In-Person verbal language interpretation services or Over-The-Telephone verbal language interpretation services appointments shall be included in the hourly rate or per-minute rate of the interpretation appointment or telephone call. Charges for written translation shall not be billed during In-Person or Over-The-Telephone language interpretation services.
Non-Applicable Charges. TSP shall not charge any detention, demurrage or storage charges against any TFC shipment when the delay is caused by acts or omissions beyond TFC’s contractors or its agent’s control. • The delivery commitment guarantee does not apply when the delays in delivery are caused by Force Majeure. In each instance, the failure to perform must be beyond the control and without the fault or negligence of TSP. • TSP will inform the shipper of weight limitations and verify that the weight on any vehicle loaded by or on behalf of TFC does not exceed limitations imposed by any state or municipality in which the shipment will be transported. • When TSP performs services that are required for normal movement of freight shipments and such services are not identified in this Contract, the charges for these services will be negotiated between TFC and TSP. Trailer recovery is not an allowable charge. • Freight will be delivered in the same condition as received at origin. Any damage or loss will be the responsibility of TSP unless due to Force Majeure event or circumstance.

  • Loan Charges If any applicable law limiting the amount of interest or other charges permitted to be collected from Borrower is interpreted so that any charge provided for in any Loan Document, whether considered separately or together with other charges levied in connection with any other Loan Document, violates that law, and Borrower is entitled to the benefit of that law, that charge is hereby reduced to the extent necessary to eliminate that violation. The amounts, if any, previously paid to Lender in excess of the permitted amounts shall be applied by Lender to reduce the principal of the Indebtedness. For the purpose of determining whether any applicable law limiting the amount of interest or other charges permitted to be collected from Borrower has been violated, all Indebtedness which constitutes interest, as well as all other charges levied in connection with the Indebtedness which constitute interest, shall be deemed to be allocated and spread over the stated term of the Note. Unless otherwise required by applicable law, such allocation and spreading shall be effected in such a manner that the rate of interest so computed is uniform throughout the stated term of the Note.

  • RENTAL CHARGES Total charges as set out in the Rental Agreement are not final. The Customer will pay any shortfall in charges to maui and the Customer will receive a refund for any overcharges made by maui. Wherever possible, any amendment to charges will be notified to the customer at conclusion of rental, and the customer agrees to payment of any such charges at that time.

  • Bank Charges Borrower shall pay to Agent, on demand, any and all fees, costs or expenses which Agent or any Lender pays to a bank or other similar institution arising out of or in connection with (i) the forwarding to Borrower or any other Person on behalf of Borrower, by Agent or any Lender, of proceeds of Loans made to Borrower pursuant to this Agreement and (ii) the depositing for collection by Agent or any Lender of any check or item of payment received or delivered to Agent or any Lender on account of the Obligations.

  • Direct Charges To the extent Cash-based Expenses are incurred by the Contractor, the Contractor shall be reimbursed for reasonable and necessary actual direct costs incurred (e.g., equipment, supplies, travel and other costs directly associated with the performance of the Agreement) to the extent required in the performance of the Work and to the extent such costs are anticipated in the Budget. Travel, lodging, meals and incidental expenses shall be reimbursed for reasonable and necessary costs incurred. Costs shall not exceed the daily per diem rates published in the Federal Travel Regulations. Reimbursement for the use of personal vehicles shall be limited to the Internal Revenue Service business standard mileage rate in effect at the time the expense was incurred.

  • Taxes and Governmental Charges The Borrower has filed all tax returns and reports required to be filed and has paid all taxes, assessments, fees and other governmental charges levied upon them or upon their respective property or income which are due and payable, including interest and penalties, or have provided adequate reserves for the payment thereof.
