NON-ASSIGNMENT CLAUSE. In accordance with Section 138 of the New York State Finance Law, this Contract may not be assigned by the Design-Builder, or its right, title, or interest therein assigned, transferred, conveyed, sublet, or disposed of without the previous consent, in writing, of the State. Any attempts to assign the Contract without the State’s written consent are null and void. The Design-Builder may, however, assign its right to receive payment without the State’s prior written consent unless this Contract concerns certificates of participation pursuant to Article 5-A of the New York State Finance Law.
