Non-Routine Maintenance Clause Samples
Non-Routine Maintenance. ▇▇▇▇▇▇▇▇ shall pay its Pro Rata Share of WinStar's direct Costs for maintenance in respect of the ▇▇▇▇▇▇▇▇ Connectivity other than Routine Maintenance Services, if the Cost of such work relating to any single event or multiple related events is greater than Five Thousand Dollars ($5,000.00).
Non-Routine Maintenance. WinStar shall pay its Pro-Rata Share of ▇▇▇▇▇▇▇▇' direct Costs of non-Routine Maintenance of the System, if the Cost of such work relating to any single event or multiple related events is greater than five thousand dollars ($5,000.00).
Non-Routine Maintenance. On the Client informing the Supplier that the Equipment is defective or is malfunctioning or has failed or is not otherwise in Good Working Order, the Supplier shall use all reasonable endeavours to ensure that one of its representatives shall attend the Location within the agreed time to perform the Non-Routine Maintenance Services. The Client acknowledges and agrees that:
Non-Routine Maintenance. Activities that require specialized skills or training that are associated with irregular or out of the ordinary upkeep of a building, equipment, machine, plant, or system. Examples: Slurry seal, carpet and flooring replacements, appliance replacements, minor roof and gutter repairs, dryer vent cleaning.
Non-Routine Maintenance. Except as provided in the last sentence of this Section 10.1(b), User shall pay and reimburse AGLN for User’s proportionate share of all Costs incurred by AGLN in connection with non-Routine Maintenance of the AGLN System and the User Dark Fibers (including repairs required as a result of Cable cuts or natural or man-made disasters), within thirty (30) days of User’s receipt of AGLN’s invoice therefor. User’s proportionate share of such Costs shall be determined and allocated as follows: (a) if the affected portion of the AGLN System includes any Innerduct other than the Innerduct housing the User Dark Fibers, the total Costs first shall be allocated equally among all of the affected Innerducts and the Innerducts housing other dark fiber; and then the Costs allocated to the Innerduct housing the User Dark Fibers shall be allocated based on the ratio to which the number of User Dark Fibers bears to the total number of fibers in such Innerduct; or (b) if the affected portion of the AGLN System does not consist of any Innerduct other than the Innerduct housing the User Dark Fibers, the Costs shall be allocated based on the ratio to which the number of User Dark Fibers bears to the total number of-fibers within the affected portion of the AGLN System. Notwithstanding the first sentence of this Section 10.1(b), to the extent such non-Routine Maintenance relates to (i) work necessitated by User’s negligence or willful misconduct or (ii) User’s elective maintenance or repair requests, User shall pay and reimburse AGLN for one hundred percent (100%) of all Costs incurred by AGLN in connection with such non-Routine Maintenance plus a management fee for such work equal to fifteen percent (15%) of such Costs, within thirty (30) days of User’s receipt of AGLN’s invoice therefor.
Non-Routine Maintenance. Non-routine maintenance is defined as maintenance/repair work that is not included or scheduled in Task A and Task B. Should the need arise or at Contract Administrator’s request, Contractor shall respond to any non-routine maintenance/repairs within three (3) calendar days or sooner from date when problem was first noticed or request date. Non-routine maintenance shall include, but not limited to, the following:
1. Work not included under Task A Routine Preventive O&M.
2. Improvement, repair, or replacement of deteriorated/broken system components, including all system’s electrical, mechanical, structural, instrumentation/equipment components where it is not called for under Tasks A and B.
3. Installation of additional equipment to improve overall system performance.
4. Replacement of deteriorated/broken system components with other parts that may not be identical but performs the same function.
5. Repair or redevelopment of any or all groundwater extraction and monitoring ▇▇▇▇▇.
6. Drilling of additional groundwater and monitoring extraction ▇▇▇▇▇.
7. Maintenance requiring specialized manufacturer or specialized subcontractor expertise.
8. Repair, cleaning, testing or replacement of storage tanks.
9. Engineering support services as required and/or requested by the Contract Administrator.
10. Install structure to secure/protect the system and its components.
11. Maintenance, repair and/or improvements of detention basins’ skimmers and risers including winches and cables. Groundwater well monitoring and sampling (as needed): Contractor may be asked to sample groundwater monitoring ▇▇▇▇▇ at North Region by Contract Administrator. If this occurs, Contractor shall perform groundwater sampling according to County protocols (a copy of which will be provided upon request) and shall send samples to County’s contracted laboratory. Sampling equipment, including generators, decontamination equipment, portable pumps, etc. shall be provided by Contractor. Ice chests, trip blanks, sampling bottles and Chain of Custody forms shall be provided by County.
Non-Routine Maintenance. Pursuant to Section 2.2.2, Sound Transit will contribute its proportionate share to non-routine maintenance work as presented to Sound Transit provided funding can be obtained from the Sound Transit Board. ▇▇▇▇▇▇ Transit will provide a detailed scope of work and cost estimate for non-routine maintenance no later than June 30 for work to be performed in the following year. Upon Board approval of funding for non-routine maintenance, ST shall contribute to the costs in proportion to the annual O&M costs for the same year the work is performed.
Non-Routine Maintenance. Sound Transit and ▇▇▇▇▇▇ Transit will reach a separate agreement to any non- routine, non-emergency maintenance items and the cost of such items prior to scheduling the work. As used herein, “non-routine, non-emergency maintenance shall be subject to funding approval by the Sound Transit Board of Directors, cost sharing will be at the same proportionate rate as all other operations and maintenance costs. Sound Transit will respond to any ▇▇▇▇▇▇ Transit proposal on these non-routine, non-emergency maintenance items within sixty (60) days, so as not to cause any undue delay to carrying out the necessary work.
Non-Routine Maintenance. Arvada shall provide non-routine maintenance of AFON. Non-routine maintenance means maintenance that is needed to restore the functionality of AFON due to modification of AFON. This includes construction and expansion activities.
Non-Routine Maintenance. AGLN shall provide telephone number(s) to the User for the purpose of reporting problems to the AGLN. When reporting a problem, the User shall provide the following information to the AGLN: · Type/nature of problem · Classification of the problem (as defined below) · Location of the problem · Any other pertinent information that may help in identifying and resolving the problem in an expedient manner. When AGLN identifies or is notified of a problem via System alarm, User, or third party notification, AGLN will initiate repair/response activities as appropriate and necessary for the type of problem being reported. Problems shall be classified according to the following definitions: Major: A major failure is defined as a failure of the AGLN System resulting in an outage condition for multiple Users (e.g., cable cut). AGLN shall have its first maintenance technician on site within two (2) hours after the time AGLN becomes aware of a major failure (whether same occurs within normal business hours or after-hours, weekend or holiday), unless delayed by circumstances beyond its reasonable control.
